Hired while waiting on my AOS and EAD

Hi everyone,

I just wanna ask if am I gonna have a problem if I started working in a company with a pending EAD? I am scheduled for biometrics soon but I dont have EAD yet, and the company hired me and I told them that everything is gonna to follow. Thanks in advance!

You came on a K1? If yes, did you not understand the limitations of the Visa? You can work after you get your EAD

You would be working illegally.  A pending EAD does not allow you to work legally.  ONLY an EAD allows you to work legally.

You can not work until you received you EAD- you will be illegally working. If you haven’t even had biometrics it will be a few months. Hope you knew this going into the immigration process.

You can ask the company for a job offer letter detailing the scope of your job, salary, etc and send it to USCUS to expedite your EAD. Sorry I don't know other details on the process because I never did this. But either way, you cannot start working until you have the EAD.

I believe that after doing biometrics you can expedite your EAD with the job offer but don't start working before then!

They offered you a job pending your furnishing them with proof of your authorization to work in the US, or they actually hired you? If the later, they have committed a federal felony.

Yes, it will be a problem. You are not allowed to work now. It is one of the disadvantage to come using K-1 Visa. Just curious, you even not have your biometric appointment yet, since when you start applying a job? EAD will take 5-6 months now.

You are not authorized to work without proper documentation. Your Social Security card should even have text across it stating that it is only valid for work with DHS authorization. The DHS authorization is the EAD.

The employer should request you to complete an I-9 prior to the start of employment, which will require the EAD or a green card.

If you work prior to having the EAD, you are doing so illegally.

If they let you work without checking your documentation, they can be fined.

 

You can use a job offer to request an expedite.

Unless you can find a way to expedite your EAD such as a pending job offer (bear in mind that the green card will not be based  on employment), you will have to be patient and wait.  A big drawback of coming on a K1 Visa.  I personally do not recommend a person going that route unless the US petitioner is inherently wealthy and has a high net worth.  It can be a strain on a relationship when the beneficiary has to rely on one income from the petitioner.  Have you made yourself aware of this?  This why my wife and I changed over from K1 to marriage CR1 visa from the US consulate.  I had to work right way-took me three months before I found my first job-part time.  And I did not want to wait for advance parole living on the US side of the northern border (Canada).

Not allowed, buddy. I’ve been sitting here for over a month trying to expedite my EAD with a job offer and nothing. It sucks but do it the right way or you can get in trouble.

Same as the other answers here, unfortunately, you cannot work at the moment.

Ask the company to give you a job offer letter, get the biometric done, then call USCIS to expedite your EAD.

If the company has a good HR department, they will not allow you to start work.  If they really want you, they will wait;  if not, continue your job search with a "thank you but I'm still looking".
