I am trying to apply for a tourist visa for my sister-in-law to visit with her two boys from Nigeria. He husband abounded then a few years ago and I don't know if this will cause an issue with the kids visas. They are 6 and 10. If anyone has any advice or experience dealing with this please let me know.  They're are not any legal documents for marriage or divorce.

First, you can not apply for them.  Your sister will have to apply for herself and the children on her own merits.  Hopefully, she can provide convincing, strong evidence that she and the children will return to her country.  That is usually Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Nigeria is a notoriously difficult embassy for a b2, esp a single mother with minor kids.. but she applies and find out. May need the kids' father's permission.

I agree with the other members who replied. A single mother of two who was abandoned will be very difficult to get a visa. Also, you will not have any involvement of the visa process. the most you can do is help your sister apply. But it is ultimately, your sister's visa and you won't be involved.

 

Here is a big question for you to ponder. What proof do you have that when they get their visitor visas they won't use it to come here and stay with you so you can help her out? What proof does she have that she is stable in Nigeria and not in need of help? These are the type of questions that need to be considered when applying for a visa from a country that is considered high fraud (meaning high risk).
