Husband’s interview is coming up soon

Timeline

My husband’s interview is coming up on 8/21 in the capital of Honduras. We have been married for five years and have a one year old daughter. He currently has DACA but we are trying to get his “green card”. He has no criminal record, he is currently going to school, we pay taxes, he has never received welfare or any cash assistance but he does have Medicaid the only reason we have it was because of the penalty we use to have in our taxes if we didn’t have health insurance. But now with all the talk about the Trump Adminstration using this as an obstacle for citizenship. I am getting super nervous, has anyone had this be the cause for getting their visa denied?!

Could i ask you . If your husband is having his interview in Honduras and he has Daca status. How and in what conditions did he left the country? Did he got a reentry permit based on daca? Or Is all figured out as far as the 5 or  10 year bar wich that could be the only obstacle he will have at the interview if he did not got a waiver before he left the us then the consular officer will tell him that he is eligible for a visa 5 or 10 years after he left the us. I dont to sound negative but to recap your question yes there are poeple that run into that issue getting their visa denied and at embassy for not researching about the 5 or 10 year bar. If not then you will be ok having all requierement in line

Yes before he left we applied for 1601A Provisional Unlawful Presence Waiver and was approved. So with all that he should be fine right? I do not work so my parents are sponsoring him and they have a very good income. So hoping with all that he should be fine.

If he has the waiver he is covered with the unlawful presence issue. Seems that you have other main aspects figured like the sponsorship. Luckily no immigration law has changed yet so as long that you are in that margin in the requirements of the law you are fine. The provisional waiver gives you that piece of mind for family unity that is what USCIS law says now, It could change but is still good. Good luck as long as you dont lie about anything in your interview you should be fine. Good luck

Let me give you a couple of tips in preparation that do not hurt is better to be safe than sorry.

 

- Make sure the passport is good, like signature on it, dates and information accurate.

- If its has been more than 3 months (really is 6 but i have heard stories that if consular officer feels like 3 there is no argue) since you submitted your police certificate get a fresh one in tegucigalpa. 

- Sealed medical envelope 

- take all the papers that were submitted to NVC originals and a copy just in case.

- If all taxes of all parties involved in the affidavit process were 2016 , they will ask for 2017 tax returns so take them just in case.  

There are more information in the tegucigalpa embassy site if you haven't look, here are some current files attached

 

For example they will ask for this info:

Applicants who have lived in the United States or have been detained or deported from the United States at any time must submit all documents relating to their immigration proceedings, including deportation orders, voluntary departure orders, verification of departure documents, proof of date of return to Honduras, and immigration court proceedings. Applicants who have been in the United States illegally and were granted Temporary Protected Status (TPS), political asylum, Deferred Action for Childhood Arrivals, or any other authorization to remain in the U.S., must submit all applications, any approval or denial documents, and cards issued to the applicant. Claims of lawful presence in the U.S. will not be acknowledged without complete documentation – the burden of proof of legal status in the U.S. is on the applicant. Similarly, the burden of proving voluntary departure from the U.S. is on the applicant.
