IR/CR Visa question

Good day people, I would like to ask is it really 3 years of tax return the minimal requirement to know what is the annual salary of the petitioner? What if she was just working for 1 year and then she started to file for CR-1 visa, would it still be acceptable even if she makes around 40-45k annual?

Although the option on having a sponsor still stands. We just want to know if it is still possible without co-sponsor.

Instructions for the I-864 state THE MOST RECENT TAX RETURN.  Then it states IF YOU believe additional returns maybe helpful ...... bla-bla.   Thus, NO three years of tax returns are NOT required, only the most recent tax return is required.

 

Item Numbers 23.a. - 25. Federal Income Tax Return Information. You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

Hello Hank! You again! Hahaha thank you for the time. Although I don't understand yet about the US tax returns but it is good to know that it is really not required.

May I know what are the usual tax return season in the US? I think you know that in the PH it is usually on jan-feb.

To answer your question, yes very much possible. Look at the I-864P for your household size and 125% of poverty column. $36,775 gets you up to a family of five, so if your family size is lower than that you are fine financially. Like Hank said, only the latest year itemized tax return or tax transcript is required. The last 3 if you feel it helps you.

April 15th each year is the magic filing deadline (for the previous year)     Currently the most recent tax return would be for 2017.

W2s for previous year from employers are due by February 1st. I have seen consuls ask for the Latest W2s after February 1st. Taxes in the US are typically due on April 15th for the previous year unless it falls on a weekend or holiday.  They require the previous year's taxes after April 15th unless you have a tax extension.

Hello, thanks for making it here. So her annual is more than adequate for the requirement.

So even that she just started working this week, once the tax season started, it would still be enough, right? Sorry for stupid question :D

That makes it only 8 months of working only(from aug to apr), with estimated of about 32k excluding any deductions from her company.

As a new employee, she should also have a letter from her employer, plus copies of pay stubs  to substantiate her GROSS yearly income.     All will be fine when including those documents.

 

Tax year is Jan 1 - Dec 31 .... new tax return date is April 15th (confusing I know).       So her income for 2018 will be from August - December.

That means it will count as 5 months of working on 2018 since she started working on August which is roughly about 18-20k on that counting.

Your wife will be able to claim a yearly GROSS income that exceeds the amount shown in the tax return simply by having the employer letter and pay stubs.

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
