please someone help me with this question. I am really frustrated. Different lawyer giving me different information.

I am in  my conditional GC and was supposed to file for i751 in November 2018. but a month ago me and my US citizen wife got divorce and the divorce decree is issued now. I heard from Visajurney people  that I can file i751 as soon as I get my divorce decree and do not have to wait until 90 days before the GC expiration date. my lawyer told me I can file i751 now, but I just called USCIS and they told me regardless of being still married or divorced, I have to wait until 90 days before expiration date.

please some clear me.

If your divorce is final, you can file for ROC before the 90 day window.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You have to wait 90 days before expiration date.  You are not entitled to special treatment for getting divorced!

Yes, you can file prior to the 90 day window with a properly created waiver.  You should expect extra scrutiny, so consulting your attorney might be a good thing...

You can file for RoC when your 90-day window begins. So, include your divorce decree in your packet and select the option on the form that you will be filing alone.

You will need to select the following option:

This is incorrect.

If the divorce is finalized, he can file I-751 with a waiver before the 90 window begins.

@newyork1234 Yes, it is. You are eligible for VAWA. As others stated earlier, you do not have to wait until November, 2018. You can file now.

12/11/2018 - I-751 mailed (requested a fee waiver) to Lewisville, TX via FedEx

12/13/2018 - package delivered 

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed
