Hi everyone. If u read my old post (well its not old old) you will see tht i asked about K-1 visa. And since it seems like it will not get accepted so i want to ask u guys about CR-1 visa. So lets say i get married with my fiance (US Citizen) and that means he has to come back here first and then get married with me right? And since my husband is allowed to file the petition from here (my country), my question is can my husband stay here in my country while we wait for the CR-1 visa? Or my husband has to go back to the US and work there while we wait? Because to be honest we dont wanna be apart for so long 😕

Of course he can stay there with you during the process.

 

Now he does have to be able to provide eventually an I-864 financial support affidavit, so if he isn't workin he would need a joint sponsor to cover it.

 

Also he needs to maintain, or be able to show US domicile during the process such as bank accounts in the US, property, living arrangements, job offer or work, ect.

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

He can stay however long he wants in your country depending on his visa (if there is one) over there. No one wants to be apart for too long but it is part of the immigration process. He will still have to show proof of income later on and US domicile.

Does he need to have a house? Like his own house? Or it could be his mom's house as long as its the place where he lives?

So if we have a joint sponsor, he can stay here without having any job?

I'm not super experienced in the domicile area but I believe being able to show somewhere to live such as his parents would suffice. Again keeping and maintaining a US bank account is helpful and lining up a job before you go can also be beneficial.

US citizens require visa (in some countries) if they want to stay there more than 90 days. So check that also. 

K1

AoS

03.2015 - AoS started.

09.2015 - Green Card received.  

RoC

24.07.2017 - NoA1.

01.08.2018 - RoC approved.

Yes. Or if he can work there that's fine too or remotely from there for a US company. Whichever really.

If he has a job remotely from there for a US company, then does he still need a joint sponsor?

He wouldn't if he makes enough to cover the 125% poverty guideline, and can show that the job will continue when he got back to the US. If he can't show either of those then go with a joint sponsor.

I stay with my wife in Romania while we're waiting for the CR1 process to play out. I had to receive a temporary residence permit here (so check the requirements of your country), but being a spouse that usually isn't a terribly difficult ordeal. I just couldn't handle being apart from my wife, and I am blessed to have a job that allows me to work from anywhere (a lot are not so fortunate to have this luxury).

 

I have maintained a lot of ties to the US as my country of domicile (my employment is still US based, I've maintained my living place, utilities, bank accounts, etc.), so be sure to keep all of that in mind. If that is a difficulty for him, you can go the route of showing intent to re-establish domicile and use a joint sponsor for the I-864.

I stayed with my husband while we processed the cr1.  We decided to have quick wedding in the states when he visited for a couple months and I was able to fly back with him to Belgium and apply for residency while there. I didn't need a visa,  at the time, but each country is different.   So definitely look into the requirements. 

I did not have a house or anything lined up when we applied,  but we were approved by having a co sponsor and using my parents' address. I also maintained bank accounts over here while I lived abroad.
