Hi! I really need VJ members help here! So my husband's interview is next week on Aug 14th at Mumbai consulate in India and we are a bit confused about one of the questions on DS-260 that we already filled out with the help of a lawyer -

My husband has been to USA previously on student visa (F-1) and after doing his masters he then got approved for I-797 (basically NOA stating his petition was approved for H1B).  He traveled to India after our engagement and when he went to the US Consulate in Inida for visa stamping they gave him a 221 (g) form and it is under administrative processing until now! So went ahead and filed for spouse visa after getting married last summer in India.  

So one of the questions on DS-260 under section " Previous US travel Info"- " Have you ever been issued a US visa and the visa classification." We answered "YES" and for the visa classification my lawyer suggested to write "H-1B visa." But me and my husband feels that it should be F-1 visa insted of H-1B since he never got the H-1B visa and the status still says under administrative processing. 

Please help as I am freaking out and his bio metrics appointment is this Thursday!

Yes you should have put F1 visa not H1B. But what is done is done and can’t be undone till the interview. So relax and have your husband clarify it during the interview if asked. I don’t think it’s gonna be a big deal.

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2017-01-30: Interview

2017-03-02: Oath Ceremony
