Unofficial Wedding party when applying for K-1 Visa

USCIS customer service really just answers basic general questions about the process, what forms to file, etc.  Most of them (not all) really have no clue about the immigration process other than what can readily be found on their own website.  It is the L2 (Tier 2) officers that are able to give more concise info over the phone.

 

Sending in photos where you "dressed as bride and groom", and then a letter pointing out that there are more photos where you appear as "bride and groom" is going to certainly make a CO view you as "too married" for the K1.

 

Hopefully, you didn't refer to your intended as "my husband" in your letter as well?

Omg i wish i could stop my fiance to not send it last night. Now i had to get married and file the CR-1 visa which is means my fiance has to come back here and do all this stuff and then be apart for around 12-17 months 😞😞

  You can try to proceed with your current k1  ,  remember there are more fees before the interview , like the medical.  If you consider all that money a throw away , go for it ,  I'd say you have less than a 10% of being approved but you may get lucky.   I would just get married with all the paperwork and file a CR1 and consider the K1 a lesson learned.  The K1 really isn't faster anymore even if it does get approved the first pass, 

This will not be over quickly. You will not enjoy this.

Did he just send it off last night? Was it by traceable mail service (certified, registered?). If so, he may be able to do a stop delivery.

So are u saying that if they want to reject it, then they will reject it in the interview and not now?

If he sent it USPS he can put a stop to the package and have it sent back to him. It cost me about $13 US and they don't even have a clue where mine is. It's a just in case it pops up again.

I'm sorry but this is the exact reason why immigration process and paperwork can't be rushed. You need to have all the information and ask all the doubts before filling. Research should be done before not after.

 

Indeed this is a very bad situation, you'll be for sure rejected, and even if you withdraw it, you still paid $535 just for the rush. I would follow the advice the experienced members here already give you: withdraw the application, get married legally and apply for a spouse visa instead.

 

Symbolic ceremonies can be a real problem for immigration processes, you have to be VERY clear about the information you provide and not let a space for doubt in any way. This misunderstandings might lead even to a fraudulent suspicious by the CO later at the interview. It's better to do things the right way and disclose all the information.

What does "withdrawal" mean? And what happens if i dont withdrawal the petition? Thx for your advice

I think, not sure, that you can call USCIS once they receive the case and ask for a withdrawal, meaning you no longer want to keep the ongoing process.

 

I know that people who got divorce after filling or maybe if they break up (case K1) have to do this just to notify the process is no longer taking place because well the relationship ended. If you don't, then it would go its natural way and after 6-8 months you might get RFEs or a straight denial on the case (or if you are very lucky, approval but later it most likely be denied at interview). Either way the record of the filling will be available for USCIS and if you decide to file again under spouse visa, you'll have to disclosure and explain what happened with this K1 application.

 

Again I'm not sure about withdrawal process so maybe wait for more experienced comments.

If you do not withdraw it, you will be forced to wait until they either approve or deny it. If they deny it, they won't let you try to fix it, you will have to let it die and then get married to file the spousal visa.

@Suzanr Since you (or your fiance) had already paid the fee, the worst scenario - you will get a denial of the I-129F petition (and, possibly, USCIS may acuse you of misrepresentation, as someone stated this earlier). You provided the explanation that the party was not an official party. In my opinion, you have a slim chance to get approved.

 

I agree with previous responses of VJ members that your case got complicated due to these pictures and unofficial wedding ceremony.

However, I believe you still have a chance, although very-very slim.

 

Someone asked you already here, in which country your ceremony took place? This is an important question because in some countries even unofficial marriage ceremony may be considered as marriage for USCIS.

12/13/2018 - package delivered 

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed
