Hello!

Please, I would like help with these questions!!

EDIT: Is it acceptable to provide more proof of bona fide marriage with newly acquired documents? Acquired after the interview?

For example, can I send an IRA acquired after the interview and/or other new documents/bills/ pictures taken acquired only after the interview? 

Proof already presented at the interview: 
- driver license of both showing the same address 
- joint credit card 
- joint lease agreement 
- joint bank account 
- pictures (all we had)

Unless they issue an RFE or NOID, I don't think you can nor would there be any reason to send additional information.

Is there a specific concern regarding the interview?

Oh, yeah, sorry! I forgot to add that it is a RFE issued after the interview! I'm afraid I can't edit my post anymore.

 

So yes, the officer wasn't fully convinced our marriage is bona fide with the evidence presented at the interview, ie those I listed on the opening post, and they sent a RFE letter now.

Ah, okay. Then yes, you can (and I would suggest doing so) sending in anything new that helps show a bona fide marriage. Obviously anything that started after the interview may be viewed with a bit more scrutiny, but it is better than nothing. Anything that occurred prior the interview that helps the case should be included as well.

It's probably not needed, but I would include it as well so they have it on file with your case (in the worst case event you need to appeal or something...not to worry you in any way at all...just covering bases!).

I asked the same question at an "ask-a-lawyer-for-free" website and they all responded like you did but they also suggested that I should consult with an attorney. Should I be worried or are they trying to sell their services? 

It's never a bad idea to consult with an attorney, but not always helpful or needed either. Only you know your own case. The response to almost every question on those types of sites will suggest seeking a professional opinion...both promoting their services and precautionary as they don't know your whole set of circumstances either.

New stuff isnt going to be as helpful as old stuff. USCIS typically doesnt like evidence that was 'created' for the sole purpose of being used as proof.

 

Ive read a few of your postings. I understand you are concerned. The only thing I can suggest is trying to come up with alternative evidences. Write a 3-6 page letter outlining your relationship. Start from the beginning (dating). Detail how you met, fell in love decided to marry/immigrate etc. Outline your daily routines and activities. Refer to attachments. (meaning include proof of what you describe. If you talk about a trip- even just going across town to thanksgiving at a family house attach a picture or statement from the family member. Refer to it in the letter- {see attachment A})

 

Everyone has different financial situations. Explain yours. Highlight purchases one spouse made for the others expenses. Do you both work? Both pay bills?

 

If they are not satisfied with your RFE response they should send you a NOID (notice to intend to deny). It will outline very specifically issues they have and give you another chance to address it. If they still are not satisfied you will end up in immigration court. Often the judges are more lenient in accepting proof. If you do end up in court you should seek an attny to help you.

 

getting an attny now may be helpful if you find the right one. You need someone who does more then just assemble your papers. You need someone with experience in creating proof in difficult situations. So you would need a thorough session with the attny discussing your situation and brainstorming. 

 

Have you loked through the ROC forum? There are many threads with lists of what people submitted. read through them and see if theres anything you have.

Thank you! Those are very helpful tips. Just one thing, this was not a ROC interview. I had a normal AOS interview.

 

At the interview, the officer didn't think we had enough documents to establish a bona fide marriage, said we might receive a RFE, and days later we did receive one. In this RFE letter, they list all that I could send as proof of BF marriage, but the most important things were already presented at the interview.... so, that's why I'm here.

Sorry I didnt realize this was AOS and not ROC. But the advice still stands. Check ROC threads anyway it might give you some ideas.

 

Often new couples dont have much. Usually USCIS understands this. Not sure why they are looking for more from you but it is what it is. (sometimes I suspect its for quality control purposes but who knows)

 

Bananaprincess had (within the last year or so) an issue getting her AOS approved. She got a NOID and was able to address it and get her GC. Search for her thread.

 

I dont think you can request a stokes interview. I think its just something they do if they feel its needed. You may get a second interview. If you do it will most likely be a stokes interview. 

 

Try not to worry so much. If you submit the RFE and get another interview and are still sent a NOID it might be helpful because like I said they will outline point by point what the issue is. You can then address it.

I didn't have a stokes interview, but the interview lasted for probably an hour and she asked tons of questions. I just couldn't remember specific places on "where we did what," my wife also explained that we are home all the time, don't go out much, don't take pictures because she hates it, and that we lived with my MIL for most of my time here in the US. We are only since last June living on our own (leased apt). So, those things made her doubt the realness of our marriage, which is real.
