60 days over since RFE response.

Timeline

Oh dear lord. 

 

The plight is becoming worse and worse. We started checking uscis case status update each day 2-3 times since we filed our application. VJ indicated our estimated approval date between March 15- March 30. It got over. A month more. then we received an update. But not an approval. They issued RFE. Then we waited 15 days to see what the RFE was.
We finally responded to it. RFE letter from USCIS said we should expect an update within 60 days of receipt of response to RFE
we saw other people's RFE experience here, majority were getting approved within 10 days to a month maximum. 
We called USCIS every week, they kept on giving us the 60 days timeline. 
 

We waited eagerly. 60 days got over last saturday. 

we called them today, they give us another timeline. Wait for 30 days. 

 

We have written to the senator as well, no response from their side either. 

 

We're running out of patience. VJ people please guide us what to do.

 

SO frustrating this.

Hello Dinesh Dutt,

I understand your frustration with USCIS. The system is not working properly not only in your case. You contacted a senator, which is a good thing.

 

What else you can do?

 

1) Try to schedule InfoPass appointment. It is very difficult, but maybe you'll be lucky to get one😊

2) Wait for a response from a senator.

3) Contact Ombudsman (it takes a long time to get the response).

 

And last, but not least, be patient!

12/11/2018 - I-751 mailed (requested a fee waiver) to Lewisville, TX via FedEx

12/13/2018 - package delivered 

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

What as the RFE for? Some take longer than others to resolve (i.e. verification of documents).

The case could also be in background checks, in which case there is nothing to do but wait.

Keep checking up on the case, and submit status inquiries. You can do this via a congressperson as well (typically it's best to call their office and see how they want to get the request...a blind mail may not be best suited for that office's process).

I have seen people talking about this a lot that RFE approval depends on what the RFE is. So does it mean that they do start working but it takes a lot of time for them to approve it?

Suppose RFE1 was for mere a signature that you missed. Simple thing, they receive it, 10 days it stays in the wait, 11th day they work on it, 10-15 minutes, all checks approved. 
and then RFE2 was for bona-fide marriage. They receive it, 10 days it stays in wait, 11th day they start working on it, it takes 1 month for all checks.
 

 

I guess even if the case is complicated and they need background checks, it should not take more than a month. Right?

A month of time investment on case sounds too much as well.

Basically, yeah. They typically try to issue an RFE for all issues they notice at once, but that's not always the case. But some RFEs are very simple (missing checkbox or something) and some are more complex and take more time (i.e. validation of an affidavit of birth due to no birth certificate being available or something)

Although background checks have no time limit...they are not performed by USCIS. They are basically a black box...USCIS requests it then they have to wait to hear back from the various agencies.

Who do they perform the Background checks on? Petitioner or Beneficiary?

I believe the I-130 is focused on the petitioner...they do background checks on the beneficiary after the interview as well, but it's possible they do an initial one on the beneficiary as well. I really don't have more insight into the process...just observations from others over time, sorry.
