As far as blaming the current president, it most certainly is justified. Since he became president, processing times have increased dramatically. It's his administration. Remember the saying, the buck stops here? 

 

The processing times ebb and flow. Every year. There were crazy long periods when Obama was president. You can look it up.

To put this in a way everyone could understand, the government wrote laws that stated that USCs and legal immigrants have legal access to certain services. This is not a lie on the part of previous administrations - this is law and legal policy.

 

The government now wants to say that legal immigrants cannot have access to those services, if they have used those services (and it's not clear how retroactive it will be as the original policy memo I saw was quiet on this subject but went into even greater depth) this will be grounds for denial in a process that is their legal right to undertake. Furthermore, if their USC, legally has access to these services, as is their Constitutional right as a citizen, their use would case harm towards their immigrant spouse, or children towards their parents. It is neither in the spirit of the law nor is any way shape or form legal. But if this administration wants to really go down this path - they will lose it.

 

These are USCs, and their legal LPRs who came here the right way, pay taxes, and may utilize services which are legal for them to use.

 

I'm curious what else this new memo implies to say. The old one went so far as to say if a USC and their immigrant spouse did not buy ANY health insurance, or did not maintain health insurance continually (which is also against the law!) they would be penalized. This is not smart immigration policy, it's downright harmful stupidity.

My confusion is this, and hopefully you (all of you) can help me better understand:

 

When I filled out my affidavit of support for my husband, it was made clear to me that I was to take care of him. Financially. That he was NOT to become a public charge.

 

As of now, the USCs and LPRs aren't in danger of their rights to move forward, but if this passes, they will be. But we technically don't even know if they can make it retroactive to actions taken before the law was passed?

Because Obamacare is being counted as government assistance....despite it being MANDATORY for some people. Including my LPR and myself.

2015 March 25: Case complete at NVC (apparently it was forgotten, which is why it's >90 days)

2015 May 28: Interview date!! -- Visa Rejected, "missing" paperwork.

Wrong military papers. Not enough Intent to Return to the US. I cannot be financial sponsor because I am overseas.

2015 June 18: Mailed all missing documents.

2015 June 23: Consulate rec'd missing documents.

2015 June 25: Status moved to AP. But still lists status as "SEND DOCUMENTS". Emailed...

2015 Aug 6: Received Visa in mail

2015 Aug 18: Arrived in US
