Hey guys!

I am a natural born us citizen who finished education in the Philippines during 2009 to 2017. My girlfriend gave birth just last January. I applied for CBRA but received an email today that my application will be denied since I did not reach a minimum of 2 years in the US after I turned 14. This was because I was in the Philippines studying and finishing nursing school . I was able to take a few month vacations but it was still not enough to reach the 2 month mark.  I applied for my 6 month old's CBRA so he can get a passport and visit California sooner or next year so he can meet his other lolas haha. So what should I do now? A cbra officer actually called me earlier and I was lost of words when  I heard the DENIAL notice so  I couldnt ask questions since my mind got blanked out.  Before applying for CBRA, I knew about the 2 years after 14 requirement but I thought it was a case to case basis since I was born there. Unfortunately , nope. She said that I should file petition instead? The fee seems to be around 500. Is this the best option to do so my son can meet his family while he's still a little one? Sorry btw I accidentally posted this without info so here I am editing this. I am new btw. Thank you so much!

hi

 

if your child doesn't qualify for crba, then the only option is to file for him

 

the petition will take over a year. once the baby enters the country he will derive your citizenship and you can apply for a US Passport

 

your girlfriend will have to authorize the child to leave the country, as he will be staying with you

 

so what are your plans about your girlfriend?

Hey thanks for the reply!

I still didn't take the nursing licensure   exam in the states and  not yet working. For the plans of my girlfriend, I don't want to rush things specially the fiance visa. I am focusing on being a US registered nurse and being financially stable. She still has one year in  the MEDTECH field but was able to do a tourist visa years ago. I came here to the Philippines again last April  to help fix papers such as delayed birth certificate and CBRA papers.   . My family and relatives in the states are so excited to see him soon and I thought he would be able to get his passport done but unfortunately not.This means, I'll be heading back to the states maybe the end of the month or next to start reviewing and working so I can start supporting them.

 

Questions if you don't mind :

1) This is where i should start ,right?

2) Do you think I should complete the process by sending the form to Manila or the address in the States? Since I'll be leaving soon anyway.

hi

 

you have moved to the US so your address is your physical address in the US and yes, that is the correct form to start a petition

 

and the child will go through consular processing in Manila, so you will put that the child will have his interview at the US Consulate in Manila

 

you will send the form to the PO Box that corresponds with the state you live in, you can find that in the i130 instructions
