HI,   MY FIANCE HAD HER INTERVIEW ON APRIL THE 4TH 2018 THEY DIDN'T ACCEPT I-134 BECAUSE THE JOINT SPONSOR DIDN'T GIVE ME HER W-2 FORM, SO THEY ASKED FOR I-864, I HAVE ANOTHER FRIEND HE DID JOINT SPONSORING FOR ME. WE  BOTH WORK WITH THE SAME EMPLOYER (IN-HOME SUPPORTIVE SERVICES) WE BOTH WORK OVERTIME HE WORKS 260 HOURS PER MONTH WITH THE RATE OF $11.18 PER HOUR, I WORK 203 HOURS WITH THE SAME RATE PER HOUR.  WE BOTH GET PAID FOR THE OVERTIME.  HIS W-2 FOR 2017 WAS $34,881 MINE WAS $9000 FOR 2017 BECAUSE of I STARTED WORK ON MARCH 2017 AND I WAS WORKING ONLY 4I HOURS PER MONTH UNTIL NOVEMBER OF 2017 MY HOURS WENT UP TO 203 HOURS PER MONTH. IN THIS JOB MY FRIEND AND I ARE EXEMPT FROM PAYING TAX, BECAUSE  THE PEOPLE WE WORK FOR THEM LIVE WITH US IN THE SAME HOME ( HE WORKS FOR HIS BROTHER WHO LIVES WITH HIM, AND I WORK WITH MY SON AND HE LIVES WITH ME).  BUT THE ADJUSTED GROSS INCOME FOR MY FRIEND'S 2017 TAX RETURN WAS ONLY $4,000, MINE WAS $800 . THAT WASN'T WHAT WE TOOK HOME AT THE END OF THE YEAR,  I DON'T KNOW HOW THEY DO THIS CALCULATION. MY FRIEND TOOK $32,000 NET PAY FOR 2017. IN FORM I-864 ON PAGE 4 PART 6 NUMBER 7, MY FRIEND PUT $34.881(260X11.18X12=$34,831) FOR HIS CURRENT INDIVIDUAL ANNUAL INCOME WHICH HE IS  EXPECTING TO GET  BY THE END OF THIS YEAR (2018).  ALSO FOR ASSETS, MY FRIEND PUT $39,000 THAT HE HAS IN HIS CHECKING ACCOUNT. IN FORM I-864 FOR MY CURRENT INDIVIDUAL ANNUAL INCOME I PUT $27,234 (203X11.18X12=$27,234).  MY FRIEND HAS HIS WIFE AS DEPENDENT AND HE ADDED MY FIANCE, THAT IS 3 PEOPLE SO HIS ANNUAL INCOME OF $34,881 IS ABOVE 2018 POVERTY GUIDELINE FOR 3 INDIVIDUALS. AND MY EXPECTED 2018 ANNUAL INCOME OF $27,234 IS ABOVE 2018 POVERTY GUIDELINE FOR 2 PEOPLE (MY FIANCE AND ME). ON AUGUST THE 2ND 2018 THE CONSULATE OF CASABLANCA CALLED MY FIANCE AND TOLD HER MY FRIEND'S INCOME IS INSUFFICIENT, SO THEY ASK FOR A DIFFERENT JOINT SPONSOR.

Did you include letters from your employer about the tax exempt status? and about your pay rate. Do not expect them to take your word for it or research what you are telling them. Send facts and statements from reliable sources.

YES  MY JOINT SPONSOR AND I, WE BOTH  SENT A LETTER WITH I-864 STATING HOW MANY HOURS EACH OF US WORK, WITH THE HOURLY RATE AND HOW LONG WE HAVE BEEN WORKING FOR THIS EMPLOYER.  ALSO, WE SENT A DOCUMENT SHOWING THAT OUR INCOME IS EXEMPT FOR TAX WITHHOLD.

Did you have letter from employer stating this ? not a letter from you (doesn't count for anything. You need a letter from employer on company letterhead, signed by superior of head of HR)

his statement must include  all

him, and his wife and brother who lives with him

and you and finance and the son who lives with u

NVC told me they look at line 37 taxable income / i have a great deal in unyaxable as it is an annunity i paid taxes on when i earned the money

he must sho proof of bank account

BTW income is from  2017 (not what u expect in 2018)o

and u r not exempt from paying taxes because u live with people u work with

HE ALSO GOT A LETTER FROM HIS BANK STATING $39,000  IN FORM I-864 A PERSON CAN QUALIFY TO SPONSOR IN 3 WAYS: THROUgH W-2 LINE SHOWING ADJUSTED ANNUAL INCOME, THROUGH CURRENT INDIVIDUAL ANNUAL INCOME( EXPECTED INCOME FOR 2018 IN PAGE 4 PART 6 NUMBER 7 OF 2018 I-864) AND THROUGH ASSETS.  MY FRIEND DOESN'T SUPPORT HIS BROTHER AND HE DOESN'T CLAIM HIM IN AS A DEPENDENT BECAUSE HE HAS HIS OWN INCOME, HE ONLY CLAIMS HIS WIFE. That might make you exempt from California state income tax if that's a California law, but I don't think it exempts you from federal taxes.

 

Also, can you please not type in caps.  It is like yelling and also very hard to read to help out.

1/7/15 - NVC scanned in packages. Let the countdown begin...

1/30/15 - FINALLY got a reply to my email to remove the attorney from the DS-261

3/9/15 - Called NVC and they have checklisted us for an "incorrect" decree absolute from the UK, even though it is the legal official document. Have requested a supervisor review.

4/28/15 - Called and NVC said supervisor had reviewed and now claimed that the decree absolute was not included. After disagreeing with the less than helpful lady on the phone, and her not being able to get the review time right. (She kept changing her story between 42 days and 30 days).

4/30/15 - Sent the same copy of the decree absolute to the NVC from the UK, highlighting the "decree absolute" wording with a letter stating that this is the only document provided by the UK government.

5/6/15 - Scan date for checklist received.

6/5/15 - Case complete!!!

6/12/15 - Called and interview is scheduled for July 1!

6/14/15 - Received email with interview date and instructions.

6/19/15 - Case showing as ready on CEAC.

7/1/15 - Approved at interview!!!

7/6/15 - CEAC changed to Administrative Processing

7/7/15 - CEAC changed to Issued!!!!!

7/10/15 - Passport and packet delivered!

7/29/15 - Husband entered with visa at Dallas/Fort Worth airport

9/29/15 - GC delivered!!!

5/4/17 - ROC packet sent via USPS

5/9/17 - Tracking shows delivered

5/17/17 - Check cashed

5/19/17 - NOA1 received with date of 5/8/17

5/27/17 - Biometrics appt received 6/8/17

A few notes...

  1. Avoid typing in all caps as it can be difficult to read. Also, please use paragraphs.
  2. A K-1 visa requires an I-134 from the petitioner. If one uses an co sponsor, as you have, then another I-134 is needed from them. A K-1 visa does not use the I-864...that only applies for an immigrant visa or AOS (within the US). Maybe Morocco incorrectly requests the wrong one (idk if that's the case or not)?
  3. The CO makes a call on the public charge concern based upon the totality of the circumstances. While one may meet the minimum income requirements to submit an I-134, the CO has discretion to accept a co-sponsor or not.
  4. Assuming all necessary documentation was provided (employment letter + pay stubs + tax return[transcript or 1040 + W-2s]), I would start looking for a different sponsor as the embassy requested.

IRS has determined that funds from programs such as IHSS where the provider lives with the client is excluded as earned income. Wich explains why neither of your earnings was acceptable.
