2nd edit: We are in the waiting limbo right now for this process. We didn't send a large packet at all. We didn't send all possible evidences. Just very key evidences. Like basically the stuff at the top of the list. No pics. No bank statements. But we are confident that we will be approved. Even if we get an RFE, there is plenty of additional evidence we can supply easily. Not to mention that the birth of our 2nd child is currently forecast to be late Nov/early Dec, which will be before any decision has been made in our case based off current processing times.

This interview was for the AOS, not ROC. If we are approved, I won't have a ROC situation, because we've been married for more than two years. (Thanks to USCIS, btw)

 

You're lucky you have so much evidence. I think it will be very easy for you.

The fact you've been married for more than 2 years is also probably a factor. I think overall, IO's tend to be a little more "forgiving" towards couples married less than 2 years. For couples married longer than that, I think they expect more evidence.

 

In that case, include tax returns for ALL the years you've been married as they all should have been filed as "married, filing jointly" or "married, filing separately". As well as other evidence from every single year you've been married.

 

Also sorry if I missed it but I am not sure if you answered my previous question: what evidence did you send in with your original I-130/I-485 packet??

I was also going to suggest a will. Plus, add each other as beneficiaries on anything you can - credit cards, bank accounts, and retirement accounts can designate beneficiaries if your partner is not already on the account. 

05/14: We were married!!

06/04/14: Finally marriage license was recorded & we got a copy

06/05/14: AOS package mailed via Fed Ex overnight to USCIS Chicago Lockbox

06/06/14: (Day 00) Confirmation of delivery & receipt date recorded by USCIS

06/11/14: (Day 05) NOA 1 Hard copy of receipt received

06/13/14: (Day 07) Form I-797C received, Biometrics appointment scheduled for July 8

07/01/14: RFE for co-sponsor salary and tax info, which was already sent with original package. Resent a copy on 07/08/14.

07/08/14: (Day 32) Biometrics appt.

08/10/14: (Day 65) Noticed that USCIS status has changed from Initial Review to Testing & Interview!

08/21/14: (Day 76) Received EAD/AP in the mail!

09/25/14: (Day 111) Email notice with interview date set for OCT. 29!

Truly, if you been married over 4 years you stated? That is very light evidence. Also bit confused why your wife is presenting the information and keeping track of it. Maybe she is better at that stuff, but she is not the one on here asking questions/help then. I suggest you take over the process.

I have to agree with this. I didn't realize OP was married for 4 years. This is quite a long time so paperwork covering this entire time period needs to be presented, as stipulated by the RFE.

It is what it is. I can't show things I don't have, for the reasons explained above.

The moda do not like more than 1 thread.

The main thing is taxes even if outside the USA, your spouse had to file them for the last 4 years.

 

Things people used. Text logs during relationship, over 4 yeara you must have texted. Should have a section where you had mail at the same address, did you not keep any old mail copies ever. You should get an advanced health directive for you both. Someone got an electronic lock at the same residence to proof what times each person was there. Recipts of any gifts is another one. Joint email accounts, or emails both are on ( party invitations, trip plans etc...).

 

But truly you need the health directive and more financial ties. For anyone to see a couple married 4 years and just recently after applying for AOS is commingling finances is rather strange.

Text logs is something I thought I didn't have much because I have the habit of deleting my inbox (in my phone and my email account) because I don't like clutter, but luckily I didn't delete everything and do have quite a lot of exchanged messages saved. So, thanks for that. My wife has probably way more texts and emails saved than me too. One more thing to send to USCIS. Thanks again.

Hi,

 

Sorry to hear about how your aos interview went. I believe the IO was being nitpicky as others have also expressed.

 

You should be fine. With them sending you an RFE, simply respond and supply to them what they are requesting. There are a couple of things you can send them even at this point.

 

I would suggest, to send them (on top of what you’ve already presented to them):

-Wills and PoA

-greeting cards sent to you from friends and family

-notarized or sworn affidavits from friends and family (at least 2 should suffice)

-if you have bills under your name and some under your spouse’s name (send them as long as they show the same address)

-copies of your joint bank cards itself (credit and debit cards)

-more pictures (time line them would be better)

-marriage certificate & marriage license

-joint tax return (transcript)

-more joint bank statements

-at this point even random mails sent to both of you would help your case

 

Our AOS interview was a favor from God. We went to the interview and not even as thoroughly prepared and informed as other couples since we filed everything ourselves. The documents we only had with us during the interview (since we were only married for two months when we had our interview) were:

-marriage license and cerificate

-pictures (about 200)

-new joint dental insurance policy & cards

-2 months of joint bank statements since time of marriage (we have our own individual bank accounts but did not have to present them)

-random mails sent to both of us

 

That was it Lol.. We did not have any lease yet since I didn’t have my ssn..no kids since we just got married..our licenses/ids didn’t even match the same address yet because we both were from different states prioir to moving in together after marriage..no joint health insurance...no car insurance since we didn’t have any cars at that time (we were ubering most of the time)...

 

But by God’s grace, we were approved..though we had to wait 2 months after the interview to get the GC in the mail.

 

So I believe you should be fine. You have good evidences and there are more you can gather to support your case.
