If the only condition he was given was his 10 year ban, then no need for a waiver since he has completed his time for the condition.

I thought you can file a petition to reverse the bar? Or the 601A waiver?

 

The 10 year bar does not apply unless you depart USA.

Being that he is most likely not in the US since he’s completing his ban. He doesn’t qualify for the I601A, which is available for those here in the US.... He should be eligible for a i601 which is the same thing only different locations that the packet is sent to. Unless, of course he for some reason doesn’t qualify for the waiver then he must complete his 10  year ban

He didn’t qualify for a waiver but someone said he needs the 212 waiver so I’m confused

Can they apply for non immigrant visa on a ban?

I do not believe so but his ban is almost over. It ends in June 2020 so I’m just trying to figure out if he needs a 212

yes but he went back to mexico on his own. i lived there for a little bit then came back and filed for a fiance visa. fiancé visa was denied and not eligible for a waiver section 212(a)(9)(B)(II) and section 212(a)(9)(C)(I) and given a 10 year bar. now his 10 year bar is ending in 2020 and i am reading in some places i need the 212 waiver and some places saying I do not. I am very confused.

9C is a lifetime ban waiverable after 10 years.

All lifetime bans regardless of violation can be waived after the 10 years?

 

Does the overstay unlawful presence in USA count towards the 10 year ban?

 

Example: 5 years overstay in USA and 5 years outside of USA?

Some can be waived immediately

 

Ban kicks in when you leave.
