Hello everyone 😊 

i just want to ask and need an idea about our case.

me and boyfriend is living together for 13 years and we already have 3 kids but then on 2012 my boyfriend and my 3 kids go to US as immigrants my mother in law petition them.

 and this month he will be going to take his oath taking to be a US citizen 🙏

then he plan to file a K1 visa for me after his oath taking 

i am thinking and it’s that possible that after his oath taking he can file a K1 visa for me? 

Because i read in K1 visa requirements that before you can file a K1 visa , you and your fiance , meet 2 years before the filling of petition 

we did not meet again 6 years ago after he go to US 

please anyone can help me ?

about this because i am afraid if he will file a petition for me after his oath taking ,

maybe we will going to have a problem because of that? 

Or it is Okay because we’ve been living together for 13 years and already have 3 kids?

You are correct. To file for a K-1 visa (the I-129f petition), one must be a US citizen. Also both persons must be single and free to marry, and they must have met in person within the previous two years of filing.

 

So really, your options are he travels to see you (why he hasn't in 6 years I don't know, seems odd), but he travels to see you, then afterwards he files for the I-129f petition.... or second option is he travels to you, you marry there, then he files I-130 for CR-1 visa for you as a spouse.

 

Those are your two options really.. having kids together means nothing honestly.

It's worth noting that if you do the CR-1 visa that you can work as soon as you get to America. If not, you have to wait longer. 

 

At this point, if he can see you and get married, that would be the better way to go.

ahmm so it means we need to meet again in person before he file a petition for me? 

Or is that ok he can file a petition after his oath taking then we will meet  next year 😅

It’s because to our kids most especially our eldest, no one can take care of them if he take a vacation.

You must meet before he files. If he files, then tries to add that later they will reject the petition and he will have to refile and spend the whole filing fee $535 again.

 

Nothing is easy, cheap, or quick with immigration. There are hurdles. Go to the top here and study the guides for K-1 and CR-1. The choice is only yours to make.

You HAVE to see each other before he files. Heed our warning. They will deny you.

The K-1 visa may not work for you. Since you already have 3 children together, USCIS may see you as already married. Either way, he will have to come and visit you; to fulfill the K-1 requirement or for you two to get married. Six years is a long time to be apart. And to not see your children for that long must be so hard. Best of luck!

You and your boyfriend should look closer at the current processing times between the K1 and CR1 visas as there is not a real big difference at this point.  Personally, I would go for the CR1 since you already have children together, is less expensive overall, and it has immediate benefits upon arrival.  Either way, you will have to find a way to meet in person before he files for either visa.  Which country are you from?

There is no way around the K1 requirement to have met within the past two years. In order for him to file he needs to come meet you. It will be hard for immigration officers to believe your relationship is ongoing when you haven't seen each other in six years. Get some face time together.

Hello 

but everyday we have a communication calls and messages and also we have a lot of proof that our relationship is still ongoing and still strong even not seeing for 6 years because he waited  to be a us citizen, that’s why he didn’t get a chance to travel to meet me 

13 years living together and have 3 children is not yet considered by USCIS?
