Should my wife wait to get her 10 year green card?

Hi,

 

My wife just passed her visa interview. On 09/20/2018 we will be married for 2 years. Should my wife wait until then to enter the US to be eligible for her 10 year green card? This will save us time and money later on.

 

Your advice?

You have 6 months from the time your Visa is issued to validate it.  I would recommend waiting until your 2nd anniversary has passed to enter.  This will save you the time and expense of doing an ROC.  Just make sure that the CBP officer marks IR1 on the Visa when you cross and not CR1.

Thanks for your advice. About the immigration fee, I can pay it anytime, it doesn't matter right?

It's really a personal choice. Some ppl would rather not wait another minute and others will wait to avoid having to do ROC. 

 

As you said yourself you will save money and time later on. Just check her visa expiry date. It's not 6 months from interview it can be less and is usually based on the medical.

Right, we are still waiting to receive my wife's passport to figure out the date. You are right, it's not always 6 months. it depends on the medical result and police clearance

You can pay it before or after entry....but the card will not be produced until after payment.

^^This is not true.

 

Mine was 6mths after my medical was done and not after my visa was approved. My medical was done in early May, visa approved in mid-June with expiration for early November.

 

Regarding the time to enter US, I suggest coming after your 2yr anniversary to get the 10yr green card. You can possibly have your spouse take a flight one week after your anniversary, as long as your entry visa is still valid within the timeframe after 9/20/2018.

I was shocked to see the processing time for I-751. Absolutely worth the wait.

If you are comfortable waiting, it will save you time, money and hassle later.  You'll be finished with USCIS for ten years or until or unless filing for Citizenship.

After being on this site and seeing the processing time as well as the stress of filing ROC I have decide to wait for my second anniversary which is on 10/04,  it is well worth the wait.
