Hello Everyone,

 

My husband's Conditional Green Card will expire on Jan 1, 2019 and we have several changes going on in our life at the moment that I am not sure of what to do in regards to gathering evidence. We have been married for almost 3 years (will be 3 on Jan 1) but we came to US in Jan 2017, hence the 2 years condition. Anyways, we are expecting our first child in September so we will be including that in the evidence. What I am lost on is our temporary move for a one year to a new apartment that we both have our lease on. Both of our license and all of our records since our move to US is my parents' current address as our permanent address. All of our joint account and credit card has this permanent address. We will be leasing the new apartment for a year (temporary) starting in August as we had to due to the new baby and my Mother-in-law coming to US for the baby and plus there was flooding at our current place that is not good for us. Anyways reasons aside, I wanted to know when we file the forms, should we use our current permanent address or use the new apartment address. We plan to keep the mailing address to be my parents' place as it is both of our permanent address until we decide to move elsewhere permanently. Both of our employers' have the permanent address and my husband just got a new job that lists the permanent address. The only thing we both have jointly in our name is currently in our savings account and 3 credit cards. The new car we bought last year is under my name as I was the only one working at that time and the same goes for insurance. This new lease and utilities will be under both our name. What should I do? We will be filling in September as soon as the letter comes and as soon as the baby is born.

 

So can someone help us? What is the best way to move forward?

It really doesn’t matter to be honest. It looks like you have enough evidence for ROC. The address doesn’t matter as long as it matches what USCIS has on file. If you’re not gonna change USCIS don’t change the address. If you are using bills and the lease to the new apartment as evidence you should change address on USCIS so that it matches. Technically you are required to change your address with USCIS if you move but if your old address is still valid I don’t see a problem as long as you can check your mail. Personally I would change it just because I like to be up to date when it comes to things like that.

I had the similar situation when I filed. At the time of filing I was residing at a place where my lease was up in next 30 days. The i751 form has two different fields, one for Physical Address and the other for Mailing Address. I wrote the address from where I soon to be moving out but nonetheless still residing as my physical address and I put in my work address in the Mailing Address field. USCIS mailed the NOA to me at my mailing address and I received it without any problems.

Thank you everyone for your input. I am not concerned about mailing address. It will always be my permanent address unless we move out of state then we will most likely change it or buy our own house.

 

What I am most concern about the apartment change, wouldn't that come in the record when they perform a check? I mean we will have moved before we file the I-751. Wouldn't that be an issue? Has anyone just used their permanent current address rather than their future address to file the petition? If yes, was it all okay? I do not want to change the current address when filing because of the main reason as it will be easier since USCIS already has that address on file and changing things now will cause problem. I am not even changing my last name at the moment until my husband has his citizenship so that there are not problems.

 

Any input would really help.

Address does not matter. I have multiple addresses in USA and have never been asked about why that is the case. You can always file AR-11 to change the address if you want to. They update the correspondence address for all your cases when you file it. Also background check shows the address you report on any of your financial applications. IF I live with my friend and my name is not on the lease, no background check can detect that. Background check is not a monitoring system. It simply aggregates your information from multiple disparate government/financial systems.

yes it is okay. Your future lease does not need to be mentioned while filing. You must mention all your addresses on I751 during your conditional residency years i believe.

Thank you for the clarification. I really hope the evidence we submit is enough as me and him are leasing it together and when we file, we will have started living there and I just wanted to see if it was needed to include this new information beside our child.
