Filing an I-864 with zero income (but more than enough assets)?

My last 3 years of income has all been foreign, so as far as the i-864 goes, I have zero income for the past 3 years. However, I have stocks and savings that are above the 3x income requirement needed for spouses. Do you think that will be okay or should I have a joint sponsor?

Yes and I have tax transcripts from the IRS for all of the years for which I could order them. That said, it clearly marks it as foreign excluded income, so they know that it is foreign income that does not count toward the 125% of the poverty line.

As long as you've been filing you should be fine. I only asked because a lot of people in your situation fail to file, despite being required to.

 

Provided your assets qualify under 3x the amount required, you should be fine. Just make sure you have proof available, and that those assets are liquid enough for USCIS to accept.

Worked for us.  Make sure they are parked / banked / invested in the US and are easily accessible.

Yes, it will work but you'll get a potentially confusing email from NVC stating that your income is insufficient but a Consular Officer will make the decision on your affidavit of support.  Don't be concerned about this.  You would get the same email no matter how many liquid assets you state and document.

Why have I never, ever dealt with the NVC when dealing directly with the embassy or consulate?  Not even last year.  I hadda scan and email my affidavit when we sent in the "ready for interview" form.

NVC is not involved with cases filed Directly with a USCIS field office abroad.  Don't confuse the issue.

Exactly.

So please explain the relationship between the "potentially confusing email from NVC" to a DCF case filed in china if you could spare some of your vast expertise to do so.

Yes, all US assets with a US brokerage and checking account. They're easily accessible in that they're all stocks and cash savings.

Have only done the I-134 which is the one for K-1, but I also had foreign income which was excluded through tax form 2555. Provided tax transcripts and returns, had no issues.

 

Not at the 864 step yet, but hope it’s similarly no issue.

The difference is that NVC is not involved in a DCF case, so there will be no confusing email from NVC.  Only NVC related cases will get that email.

Yes, and I would give them one from a year ago, the latest one and two or three in between, for each account.

I was reading through this guide: http://www.visajourney.com/wiki/index.php/LingChe_NVC_ShortCut and got way thrown off.

 

It says:

Is that still true? So I would actually need $185,175 for a 2 person household??

 

125% of poverty rate for 2 person household = $20,575 x 3 = $61,725 -- but only 1/3rd of account value is accounted so I would need $185,175 in the account?

 

If this is true this changes things for me.
