Anyone know approximately how many people in December are still waiting? I feel like I am in the last tenth of a percentage.

There is not worse filling to be left behind especially when some people here have already their visa in hands or are already in USA. There are still plenty of December fillers who are waiting for a response. I do not know the exact number, but also not all December fillers are on VJ.

For all the people please contact your Senator instead of Congressman.

Our senator helped us a lot , they were very quick in response and helped us a lot.

Plus contact Ombudsman if over 270 days.

You can file a case in the federal court against USCIS if needed.

But do keep pushing them, calling them etc

Juts curious what is the difference between contacting congressman or senator. I am asking because I contacted my congressman first than I contacted the senator office. The lady at the senator office said if you contacted congressman, we senator office do not get involved. She also said you can go with one ore the other but not with both.

Hi @Victoria85

Exactly I cannot tell you the difference but I think a Senator's office will have more pull than a Congressman.

We had contacted the Senator first, then the congressman. And our Senator was very quick and prompt.

We kept calling them every week , telling them how much it's painful and all the emotional toll this process is taking on us.

According to me there are only 2 Senators per state whereas there are many congressman in every state and that is why Senator should have more power. I could be wrong though.

USCIS customer care is of no use.

Now that you have contacted your Congressman keep calling them again and asking them.

Try contacting your Senator again and don't say you have already contacted a Congressman.

Contact the Ombudsman as you are way way past the average processing period too.

Last option is to sue the USCIS because that will force them to give a definite reply.

You will not believe on the day we got our approval we had a telephone call  scheduled with a lawyer to proceed for suing the USCIS. Literally 5 minutes before the appointment we got an update just 5 mins. That was amazing for us.

But yes, these are the  steps you can follow.

I am so sorry you are still waiting , I can understand your pain and distress and there is nothing I can say that will make it better.

All the very very best to you !!

There is not a difference between congressional representatives. You can contact either. If this is the route you are traveling then try and see who is better for you. I'm sure if you research here on VJ you should find an answer. If it were me I would prioritize my inquiry's to Ombudsman first. You can email the ombudsman (cisombudsman.publicaffairs@hq.dhs.gov) and they will auto-reply with a link to a form to file a follow-up. Some additional information who the Ombudsman is and what their duty's are. https://www.dhs.gov/sites/default/files/publications/CISOMB-scope-of-case-review_0_0.pdf

Then choose a congressional representative. Your U.S. representative's contact information can be found in this handy directory, and your U.S. senator's information is in this one.

Then if you are getting no where, then it's time to bring out the big GUNS.

Please be responsible in your approach and choose one that you think works for you. Don't do all three at once as you are just cluttering up the system and that is why things are so slow in processing today. IMHO.

Thank You, Greenbaum I only contacted congressman so far. I see some people here on VJ are more "aggressive" in their approach to USCIS. This is probably better because otherwise you cannot get them moving. I call USCIS  once per week, but probably I should insist more.  Every Monday I say to myself this will be the week, but when I get to Friday still silence.

USCIS works like a turtle; slow and steady. In the past and IMHO true today, calling doesn't move the needle. Good luck.

Hi @OceansApart247 & @amy1411

when we filed our inquiry and called after we got the response back from them ("you should receive a notice of action in 45 days..."), my fiancé called USCIS and talked to L1 who was trying to be really helpful. She said that if we hear nothing by the day 30 since getting the inquiry response, we have the right to talk directly to the adjudicating officer or someone in the actual office (she called it an interview). We got approved three days before hitting those 30 days but I wonder if that's something you could try to request? Maybe it has been discussed here already, I am sorry if so, I was on a long VJ break and completely lost track of these threads.
