How long does USCIS give us to respond to the RFE, is it still 90 days or did they cut that down? Anyone know ?

Hi, for me was around 88 days. From Aug 3rd to Oct 29th  and 5 days to be approved after received ☺️ I was freaking out that was going to take the 60 days mentioned in the notice.

Thanks ❤️ I’m queen of overthinking 😂😂😂 I really need to stop 😆

I’m sorry you still waiting. I’m also a queen of overthinking so I was getting very anxious everyday reading everybody’s updates here 😅 Until we finally got our RFE on Aug 3 for a missed question then the anxiety hit me hard until I decided to just relaxed and then without expecting so much I got approved on Aug 21st. We  have already our NOA2 notice and we are now  getting ready for the next step ☺️

So so hang in there, praying for you and all that are still waiting 🙏🏻 I’m sure you are gonna get an answer this week as a Bday gift ☺️

My fiancee contacted her congresswoman's office Friday and today they emailed her with the response they got from USCIS, which is basically what @JayHouser and every else gets. Which was:

“Your constituent’s case is pending review with an adjudications officer. Your constituent should receive a notice of action on his case within 30-45 days. Please contact us again if the timeframe has expired and the constituent has not received a notice of action* from USCIS.

*A notice of action may be in a form of Approval Notice, Denial Notice, Transfer Notice, Request for Evidence, Notice of Intent to Deny or Notice of Intent to Revoke.”

I was thinking of now contacting the ombudsman, but on its site it says to contact them only if we're 60 days past processing times. Should we go ahead and try contacting them anyways?

Praying it’s just an easy one for us. I am thinking of IMBRA as our rfe. I was expecting that we will receive the mail today but Informed delivery doesnt show an incoming USCIS mail. How about you guys? Any expected day for your rfe to arrive? @kmza89 they generated our rfe the same day as far as i know coz they updated their system on 24th same as mine. Most likely also this week.

@Adam Zollinger have you prepared your needed documents?

I'm expecting Wednesday? But who knows.. I'm excited to know what it is. Please keep me posted when you receive yours @Lucy&Jason

And what do they mean by "pending review"? Does that mean that mean they have yet to even touched or case? Lol

Edit: We also got another automated email today saying they last took action on our case on June 18th. BUT two weeks ago it said they last took action on our case on July 18th. So idk what's up with these dates.

What do you think is your rfe?

I just called and spoke to Tier 2 again, and they told me that they did decide that they needed an RFE, but they have not mailed it out yet. So there is not date available yet. I asked if I could have it faxed and they said that that was only an option 15 days after it is sent through mail.

Either way, I am staying positive and working my ### off. Hoping to celebrate American Thanksgiving with him at the end of November.

After you get your case number from NVC it would be a good idea if you were to connect with the VJ sub forum for all things dealing with the US Embassy in the Colombian and they will answer your questions for the processing of your visa from their personal experience. Link:

http://www.visajourney.com/forums/forum/96-mexico-latin-south-america/

Get the US Embassy Colombian K-1 Packet 3 (P3) at  https://drive.google.com/file/d/0B7hB3bl9Snfkb0NiMVFUd2JsVjA/view  as this is your bible needed to complete and receive your visa. The required documents are included and use the EL as a check list. Once you have completed or gathered the required documents you'll be ready for your interview. If it is not on the Embassy letter, it probably is not needed.

Last but not least, READ the pages on the US Embassy website for your country so that you are up to speed.

http://bogota.usembassy.gov/

One last place to check for information would be the VJ Wiki found here: http://www.visajourney.com/wiki/index.php/Special:AllPages and here http://www.visajourney.com/consulates/index.php?ctry=Colombia&cty=Bogota

Good luck and God's speed.

I don't really believe in these days and numbers from USCIS anymore. Two weeks ago they said they took action on my case on July 18th. Now today they're saying that they last took action on my case on June 18th. How does that even make sense?

So these "30-45" or "45-60" days, are probably just their default answers to inquiries and they probably use either or. Idk what to think or to do at this point.

I got an email this morning from USCIS and it says they "We are still reviewing your case aand there are no updates at this time" I know some of you have received this email... My question is for those who have received the email stating the above. Once you received the email what was next or how long did it take them to send the RFE or the approval. I was suppose to have a RFE request on the 13th of August but up until now it has not been generated....any answers would certainly help me.

@SilverMonk The USCIS has issued a Ruling, effective April 17, 2007, that gives adjudicators flexibility in determining the length of time a petitioner or applicant has to respond to a Request for Evidence (RFE) or a Notice of Intent to Deny (NOID). Currently, the standard deadline for response to an RFE is twelve weeks (84 days). NOIDs must be responded to within thirty days. Under the this regulation, the USCIS will determine how much time should be permitted in any given case, with maximum possible time being what is now the standard response deadline. That is, adjudicators will set deadlines for both RFEs and NOIDs that could be up to twelve weeks in case of RFEs or up to thirty days for NOIDs. No extensions of time are permitted.

What is IMBRA? I did not ask the date of issuance. I just called back to get it and Tier 1 told me "we don't see an RFE" so I am going to wait 103 minutes for a callback from Tier 2 so I can ask for more info. I have all information ready to go at a moments notice so I should be able to respond immediately.
