Does anyone know if USCIS requests FBI Name Checks (NNCP) for I-129F petitions, since they are technically non-immigrant petitions as far as USCIS is concerned?  The FBI page about NNCP states:

 

The following are the major contributing agencies to the NNCP:

  • U.S. Citizenship and Immigration Services (USCIS) - Submits name check requests on individuals applying for the following benefits: asylum, adjustment of status to legal permanent resident, naturalization, and waivers.

It doesn't mention visa petitions, but who knows how up-to-date that info is.  The only other background check I've seen mentioned that is used by USCIS is the IBIS, but that supposedly gives nearly instantaneous results.  Yet everyone talks about some petitions being hung up on background checks...people have even been told so by some CSRs.

 

I got to wondering about background checks as a potential cause for our petition taking its sweet time since our case is quite straightforward with both parties never having married and no kids, not from high fraud country, etc.  Neither of us have any criminal record at all, and I have a very unusual combination of first and last name; I would be quite surprised if my name returned a hit in a database.  Then I googled my fiancé's name to see who else is out there with his name, and it turns out it also belonged to a rather high profile convicted killer.  I wonder if this would return a hit and trigger the need for "manual verification" for NNCP, which takes up to 30 days to complete.  Though I think NNCP also includes birthdate as a variable, and their birthdates are 25 years apart, so who knows?  But then, this is all moot if USCIS doesn't request FBI name checks...

Told my fiance to wait until the end of this month. He said its been too much, if our case was forgotten or what. They just say you can file another inquire. Left us with nothing. No information at all.

Hi all. Sorry to hear so many of you are still waiting. I’m sure most of the January filers should be getting something soon. 

I just wanted to update again that I was approved on Monday via finding out online from uscis website and I received this in the mail on Thursday, so it came very quickly. 

I’ve attached what I have received.

good luck to everyone still waiting and be strong. I know it sucks :(

I hope this helps but I know the answer your looking for is "where is my approval"! If you look below your post that I just quoted and above this entry you will see something I posted this morning about the process as seen through a XUSCIS adjudicating agent. It makes for a good read.

 

As part of its benefits adjudication process and as required by law, the United States Citizenship and Immigration Services (USCIS) conducts background checks on petitioners and applicants who seek certain immigration benefits. These background checks consist of four separate checks against systems within Department of Justice (DOJ), Federal Bureau of Investigation (FBI), and the Department of Homeland Security (DHS). In order to facilitate the collection and transmission of information necessary to complete background check processes, USCIS maintains five information technology electronic systems: the Fingerprint Masthead Notification System (FMNS), the Customer Identity Capture System (CICS), the FD-258 Tracking System - Mainframe (FD-258 MF), the Benefits Biometrics Support System (BBSS), and the Interagency Border Inspection System (IBIS) Manifest. USCIS is conducting this privacy impact assessment (PIA) because FMNS, CICS, FD-258 MF, BBSS, and IBIS Manifest collect, use, and share personally identifiable information (PII). This PIA replaces the previously published USCIS PIA for the "Background Check Service (BCS)" which describes planned background check-related systems that were never implemented. Upon publication of this PIA, the BCS PIA will be retired.

RE: I-129F Case

USCIS records confirm that the referenced case is pending background check clearance. USCIS is committed to adjudicating immigration benefits in a timely manner while also ensuring public safety and national security. A small percentage of applications and petitions have unresolved background check issues that temporarily delay adjudication. Although USCIS makes every effort to resolve such cases promptly, USCIS is unable to speculate when the background check will be completed. 

If a background check reveals an issue that may impact an applicant’s eligibility for the requested immigration benefit, further inquiry is needed. The inquiry may include an additional interview and/or contact with another agency for updates or more comprehensive information. Upon gathering and assessing all available information, USCIS will adjudicate the application as quickly as possible. 

 

USCIS realizes that the constituent may be frustrated by the progress of their case. However, the agency must balance individual inconvenience against broader issues of public safety and national security.

Going to see my baby on Friday 😍NVC received our case 2 weeks after our NOA2 and our case was sent on the 21st and got to the consulate on Friday the 24th, we booked our interview yesterday the 25th since we have all our documents already. Interview will be on September 18th.

Thank you so much @Lucy&Jason I'll be looking at the thread waiting for everyone to be approved soon! This is my birthday week so I hope my wish for January to receive many approvals this week will come true! 

Also just taking advantage of this post to say that at least for Italy there were dates available starting on the 5th of September so any Italian applicants can keep in mind that after Consulate receives you can get interviews in less than 2 weeks out.

Yes they already changed the status on website. They emailed me Saturday evening that they already took action on our case. I guess we have the same adjudicator. We have the same received and rfe date. Hopefully monday we will already have the letter. What do you think your rfe is all about?
