It's just too much. I popped up here once in a while. Now I'm  back to see my fellow VJers with 220++ days are still waiting and I'm sure theirs are not complicated cases. My fiance called and was told to wait for another 30 days and got referral number. @I.Kat shared her experience on receiving informed delivery. So I shouldn't be too excited if we get one. I let my fiance take care of it because my weak heart can't take it anymore. I will go back keeping myself busy and keep the champagne for NOA2 and another once we make POE. I really hope next week will be a good week for all of us January fillers!!

Hi!!! Im still waiting for some news, we have called this week again and file another inquire. We have two inquire numbers but they dont say anything else. Im getting really really frustrated. Im on day 227 and this week coming will ask help from senator office. 😞

We knew from the beginning to expect an RFE. Our passport photos slipped out of our petition (and we didn't realise until we got home and went through our folder and voila they were there NOT in the post with the petition). We tried to send them back with a new cover letter explaining our oversight (and stupidity, really) but they sent it back so we figured we'd wait for an RFE. Now the new policy (of which I do understand why) is making me a tad nervous that we could just get a denial instead. 

 

*sigh* I'm trying to keep busy. We just want to know either way. If they will deny us, just tell us and we can work on plan B- whatever that is. 

*IF* they deny us, for not submitting required documents, does that mean we could reapply as long as we quadruple check we include e v e r y t h i n g? Or don't bother repplying...? Just a, hopefully, hypothetical question. 

 

And his boss still can't confirm whether he can take time off in October or not. I don't mean to be a downer! I honestly just want to get confirmation of his time off so we at least have a trip to look forward to! ☺️

Let me see if I can tackle your concerns (fears).

 

What's holding up the decision is their workload. More importantly is the background checks. You may receive a RFE for the photos, it's not a BIG thing. You answer the RFE with whatever they request. Nothing more nothing less the what is asked. The "new policy" has no effect on your case. Basically the are trying to cut down on their workload of frivolous applications. Some people don't have all their information, and I mean don' have like in tons, and so USCIS is given the task of weeding out those people along with many other stupid things people are doing. Yours is a good case and will not be effected by NOID.

 

Plan B is petitioner visits the beneficiary and marries. You file a CR-1 visa and you are almost guaranteed an approval.

 

Yes you can reapply for a K-1 again if that's what you want to do, but I really don't thing that will happen especially over pictures.

 

I hope this helps. It's a hard process but what makes hard is "over thinking" and "high expectations". They are mind killers. Eliminate those two and this is a walk in the park.

After being in RFE limbo for 2 weeks finally they changed our status! I know it is not something to be excited about but Im just happy to know that we are finally going to know what is needed from us!

I got that exact same message this morning.  It is truly bittersweet, but at least we know our petitions have been located in the massive stack of applications.

 

At first I was worried, then I was upset.  After having a small freak-out, I’m feeling more relaxed and hopeful.  No one WANTS to get an RFE, but it doesn’t mean we won’t be approved. 

 

My heart goes out to all of you who have to wait so long, so far away from the person you love.  I live in Canada and it’s not so far for me to visit my fiancé or for him to visit me; however, just because I live in Canada, it doesn’t mean it is any faster or easier for me to get through the K-1 Visa process.

What did they say regarding the first inquiry that you filed?

The senators helped us. We actually co contacted them 2 months ago. I guess being an 80's child and paranoid helped cause USCIS was in limbo with us and our senator helped

Thank you so much @Greenbaum your response has helped alleviate some of those fears. And if there's anything to learn, it's to ensure we double, triple, quadruple x 10 everything is in order for the next stage. It is definitely a hard process, and I'm working on the 'over thinking'. I thought I'd done super well until we hit the 6-7 months 🤣🤣🤣
