I got an RFE today.  Ir was dated  08-17-18 but I have not been to the mail box all week.    They only need a  letter from my  finance stating she will marry me within 90 days of coming to the united states. I know I sent one the first time but I did not make a copy.  I will send another one.   Also I missed the criminal intent page which is easy I have  already checked no criminal record and signed it and dated it.  This makes me feel good at least I know my case is being worked on and I am almost finished with this step!  01-26-18 Noa1 and RFE 08-17-18.  

 

BTW  website still say case received.  No email or text.  only mail notification.  

Just a little caution in responding to and RFE where they are asking or directing you to complete the "criminal Record". Think back in your history and if you ever had a case dismissed or expunge then you SHOULD make that clear with USCIS. Not long ago a fellow got the same type of RFE and he answered it and set it back not thinking about a case that was expunge in his youth. Failing to expose that point caused USCSI to deny his visa application. He had to return back to his fiancé's country and marry her and then submit a CR-1. From start of the K-1 to her stepping on US Soil will be about 2 years.

 

No need for a rebuttal. This is just FYI for you and others.

Called tier 1 at 8am this morning when I got to work. Spoke with a young guy. He read his usual script of it’s going to take 60 days blah blah I said thank you can you transfer me to a tier 2 and he said for what. I said to speak about my case and he said for what. I said I have questions. He said WHAT questions. Really rudely and I said THANK YOU I WILL HANG UP AND CALL AGAIN. When I hung up I was like Oh Oh maybe he will flag my case so I hung up and called back really fast and got another young man. (Mind you I called the 21 and they read their usual script and said to wait 60 days) I said I figured that much since all the RFE was about was a letter of intent. And he said yes it says right here, your approved. 

 

So really it’s the luck of the draw. I just got home and have the approval in my hand. 

I called Aug 9 tier 1 said he saw something flagged TWO weeks prior but nothing sent. Next day RFE was issued and mailed. Received it the 13th. Over night es it the 14th. They received/processed  it the 16th and approved the 20th and mailed out the 21st and arrived today the 24th. 

 

Just curious, how did you get your fiancé to sign and send you an intent to marry letter so quickly? Or did he scan it and sent it over to you?

He signed and scanned over and I signed my name.

And I thought it had to be a wet signature. Good thing that's not the case. Saves us a week from international mail.

Our original was wet and he spent a lot of money sending it over but it said I would marry him. This time they asked for one that he’d marry me. No they don’t need to be wet signatures and we both signed bc he first time around we both signed too.

Called USCIS 1st time tier one immediately transferred me to tier 2, left full name and was told 125minute wait time. Received call from tier 2 @5:10pm CST and was told “yes I see they took action on your case, you will receive notice in the mail 1-2 weeks” refused to tell me what action, and that they could not tell me whether approved or not....I hung up the phone with a feeling of something wasn’t right...I immediately called back and told tier 1 that I was just speaking to tier 2 about my case and that she was getting ready to tell me status of my case when it disconnected...white lie yes I know, tier 1 Ashley said; “oh on the 23rd they APPROVED your case you will receive notice in a few days!” 

 

I am still in complete shock at the same time it’s crazy how if it wasn’t for my gut telling me to call back I would have waited until Monday.... to my dear friends waiting.....KEEP CALLING everyone knows the answers to our questions so DON’T give up and don’t settle for the first time!!!!!!!!!

I'm just going to spout out thoughts. I know no one will be able to give an answer- really. 

 

I'm just nervous over the, 'a decision has not been made yet.' Does that mean they've started on our case? And what could be holding up the 'decision'? 

We knew from the beginning to expect an RFE. Our passport photos slipped out of our petition (and we didn't realise until we got home and went through our folder and voila they were there NOT in the post with the petition). We tried to send them back with a new cover letter explaining our oversight (and stupidity, really) but they sent it back so we figured we'd wait for an RFE. Now the new policy (of which I do understand why) is making me a tad nervous that we could just get a denial instead. 

 

*sigh* I'm trying to keep busy. We just want to know either way. If they will deny us, just tell us and we can work on plan B- whatever that is. 

*IF* they deny us, for not submitting required documents, does that mean we could reapply as long as we quadruple check we include e v e r y t h i n g? Or don't bother repplying...? Just a, hopefully, hypothetical question. 

 

And his boss still can't confirm whether he can take time off in October or not. I don't mean to be a downer! I honestly just want to get confirmation of his time off so we at least have a trip to look forward to! ☺️

I did the same thing. I forgot my passport picture but after 7 months they send me RFE asking for it, so im going to send them the picture and wait for eternity I guess.
