I know that they are not allowed to fax it to you until after it has gone out in the mail (which in your case it has)  If you dont get the answer you want, just hang up and call back again until you get someone competent on the phone.

My fiancee phoned on 30 July,  he was told that we will get a RFE. However, the RFE was updated on the new site until Aug 10. We received the mail on Aug 13. My fiancee did try to phone to get a fax copy, the tier 2 officer rejected, said we should wait and just hanged up the phone after my fiancee was waiting for 2 hours to get through.

 

I did see some people get a fax copy. But I think it really depends on who you talk to. Good luck

That is a great example of how a customer service doesnt know what they are talking about.  By law you have 87 days to respond to the RFE.   That's it and it cant be extended.  You need to call back and get a Tier 2 on the telephone.  Call first thing tomorrow morning at 8am EST and let them know that you called last night and spoke to a tier 1 and they were going to transfer you but they were not taking any more calls for the evening.  Let them know that you are under a deadline that cant be extended for an RFE and that you would like for them to fax it to you because you haven;t received it yet.    

Same thing happened to us. They said they sent out last Aug. 8 our rfe letter but until now we haven’t received anything in the mail. When we called them and asked about our rfe, they can’t give us any answer what was our rfe all about. No update on the website too.😣😣😣

I would call back and ask for a Tier 2 and then ask for a supervisor.  Per the USCIS manual you are allowed to ask for a supervisor at any time.

I have never seen something written that they are required to fax it to you if you request it. But I have heard others here who have asked for it and after the RFE leaves the building then they are allowed to fax it. But there is a lot of push back recently so I am still in the wait and see mode. Others here will report back on their experience. If I am not mistaken @GP1977 has a better handle on this then I do.

It's not going to be a problem. I doubt you are the first one to make this mistake   Just wait and see how all this plays out. At best you can correct at the Embassy as you will have the passport there and other official documentation for proof.

Yes it appears there are some people who are having trouble getting their rfe faxed to them. Maybe I was lucky but I have seen others get it faxed to them as well.

 

What I did was call first thing 8am est and When I got tier one on the phone I told them that I had called US CIS last night and they were going to transfer me to a tier 2 bc They had access to my rfe in which their is a firm deadline that can’t be extended. Let them know they couldn’t transfer you last night bc tier 2 wasn’t taking any more calls (doing this kind of gets it in their mindset that you should be transferred bc you were already told you would be)

 

Once you get tier 2 on the line let them know that you would like a copy of the rfe because you want to get working on it immediately as you know that there is a deadline which per uscis cannot be extended. 

 

If they say no hang up and repeat until you get someone who will send to you.

We got our NOA2 middle of last week. It was dated August 8, 2018. My filing date was January 29. I suppose my fiance should get a letter pretty soon? I don't really know what to do next. It's exciting but kinda scary too!

WE GOT APPROVED! l a s t  m o n t h........... We never got a notification through email or an update on the site (what we were counting on as my fiance was traveling in Europe with me) but he finally got home yesterday and lo and behold! OUR NOA2! 🤯 all that worrying for a month! nevertheless *clink clink* we are happy  (now time to scramble and get all the papers together again...)

I have been trying to stay away as much as possible so I pop in like once a day lol...After reading everyone's RFE story I feel a little better because I was told on the 13th that we will get an RFE and up until now we have not received the hard copy and with my calling everyday I have only been told that it looks like they requested an RFE but it hasn't been generated or gone out yet. that is the latest and greatest on my end..... I vow to call everyday from now until I get the RFE Congrats to all that have been approved and May GOD grant everyone waiting the patience to hang on!
