I am at day 215 of waiting on NOA2, and I realized that I made a HORRIBLE mistake and misspelled my fiances last name on my I-129F packet. It is Gonzales and I wrote Gonzalez. You might wonder how I could do that, and its simply because that is his maternal last name and he does not use it. It was a stupid error on my part. I am traveling abroad with him until Thursday and I cannot call USCIS. I was told from a tier2 agent 2 weeks ago that he passed background checks in July and I am just wondering if the name on the forms matter so much, or do they go by his passport? I had a copy of his passport in my packet.  Has this happened to anyone before? Have you heard of this?

didn't you check NOA1? It might be gonzales in there.

Well guys my fiance just called uscis and spoke to a tier 1 officer who told her that we are getting an rfe in the mail. Can someone tell me how long after sending them what they ask for an approval was granted. ? noa1 jan 12 old website and January 18 new website.

did they update the website? We called last week and they said the same thing to my fiance, they sent RFE last Aug 7 but we haven't receive anything and they did not update the website. so we don't actually know what's up. We will be calling again today

They did not update their website but i read on some other posts where once you are told to expect an rfe u can request a faxed copy of what type of further evidence they request. Can someone confirm this. ? Green baum or anyone.?

Yes U can receive ur rfe by fax. Have to request it obviously.

noa1 date is actually they date on ur hard copy. Sadly if u reach the magical 220 day u must wait till 225 to contact Uscis. They use what the new site says. Even if ur paper says X date. 

They added 5 days onto everyone’s accepted on NOA1

My fiance called uscis today. They will resend the RFE again (after sending it aug 7) and we tried asking them to fax it to us but they said we need to wait for 87 days for them to send  it via fax. This is ridiculous.

Resend? Did you move or something and weren't able to get the original RFE that was sent out?

Thats what the lady said. They asked california service center to mail another RFE to us. We changed address 2 months ago and they confirmed it so i dont think it is the address.

That is a great example of how a customer service doesnt know what they are talking about.  By law you have 87 days to respond to the RFE.   That's it and it cant be extended.  You need to call back and get a Tier 2 on the telephone.  Call first thing tomorrow morning at 8am EST and let them know that you called last night and spoke to a tier 1 and they were going to transfer you but they were not taking any more calls for the evening.  Let them know that you are under a deadline that cant be extended for an RFE and that you would like for them to fax it to you because you haven;t received it yet.

The funny thing he was talking to a tier 2 and they said they dont have access to the file that they would call another office to send RFE. Is that even possible? I don’t believe a tier 2 dont have access to the file.

My fiancee phoned on 30 July,  he was told that we will get a RFE. However, the RFE was updated on the new site until Aug 10. We received the mail on Aug 13. My fiancee did try to phone to get a fax copy, the tier 2 officer rejected, said we should wait and just hanged up the phone after my fiancee was waiting for 2 hours to get through.

 

I did see some people get a fax copy. But I think it really depends on who you talk to. Good luck

I have never heard of that before.  I had an RFE called them and got a Tier 2 on the telephone and they faxed it to me, no questions asked.

I know that they are not allowed to fax it to you until after it has gone out in the mail (which in your case it has)  If you dont get the answer you want, just hang up and call back again until you get someone competent on the phone.
