HI All

My mother in law wants to come and visit, so I was wondering if any of you guys had experience with this.  from what I've read and heard, she would have to request for a travel visa, but I was wondering, I saw some people filing a I 130 for their in laws to come and visit?  is that correct?

Also, do you guys have any other tips that would help, like what she should fill out and how long does that process take?

thank you again VJers!

Yea she needs to apply foe tourist visa. On her own. You or your spouse are no part of this process and you don't provide any documents nor sponsorship.

If your spouse is US citizen she/he can sponsor the mother for permanent residency. That's the i130 you mentioned. But that's for living pernamently in the US. Not visiting.

Thank you very much for that Roel, for some reason she keeps thinking that I need to do something, so I was confused.  I've also seen others post that they would do an letter to invite her? but I guess all that doesn't really matter. since what matters to the US that has ties to go back to her country right?  (her own kids, her properties, finances?)

Correct. Her own ties to her country will matter the most.

That is a common misconception in alot of countries but it isn't true at all.

Well you might be forced to do an invitation letter i134 just to keep the peace . If your MIL fails then you will get the blame.

Agree, I would do whatever they want that way you get no blame.

I want to add my MIL returned this week back to Saigon. The month went quick though I am sure she will be back since she enjoyed us showing her around the local area and spending time with her grandson.

Thanks for the tip on the form Cyclone!

you're totally right, I don't want to get blamed for it, especially when in their heads that they have notion that it's all up to me.

Thanks for sharing Cyclone.  MIL doesn't really know how it's like here, and has heard way too many far fetched stories about everything being way better.  She doesn't understand that we too, just like everywhere else, has to deal with the daily grind to survive.  It's not all fun and games, we'll definitely take her to places, but with limited funds and limited vacation time, we can't really go everywhere.  my MIL is also from Saigon, I think it'll be a shock to her when she sees that the neighbors are not always talkative, or that everyone really does their own thing here, how far places are, how far a grocery store is, etc.

What did your MIL think of the U.S?

A letter of invitation and I-134 will not be considered for the visa (https://travel.state.gov/content/travel/en/us-visas/tourism-visit/visitor.html).

Usually keeping family happy is important too. :P

Either way, it's not your fault whether they do or do not get the visa.

Unfortunately, elsewhere on the internet there is misinformation:

But, alas, I found this; https://www.murthy.com/2016/10/03/form-i-134-affidavit-of-support-for-b-1-b-2-visitor-visas/:

For many applicants, however, submitting this form could actually do more harm than good.

And this; https://www.nolo.com/legal-encyclopedia/filling-out-form-i-134-affidavit-support-help-us-visa-applicant.html:

Form I-134 is all bark and no bite, legally speaking.

Your Input Is Appreciated On This VJ Guide Proposal:

Your involvement, or your wife’s for that matter, in your mother in law’s tourist visa will only hurt her chances of getting one. If she only wants to come visit that’s what a tourist visa is for and she needs to show she can get one on her own. If she wants to move and live permanently in the US then she needs a 130.
