How difficult for company to sponsor?

My husband runs a flooring installation business and also works full time. His schedule recently changed and he will have to rely more on his workers than before. One employee went back to school, another moved out of state and his current employee is only employed for the summer before heading off to college. We have advertised for workers, but those who reply are either unqualified or unable to provide their own transportation or unable to pass a drug test. 

 

Is it impossible for us to sponsor a couple of people who we know will work well for us and be reliable?

I doubt that he would be able to sponsor people for flooring installation..  employer also needs to pass certain requirements to be able to sponsor foreigners. 

 

Work visas are for specialists. Educated (bachelor degree)  and highly qualified people. No offense but flooring installation isn't in the same area as IT, for example. At the end, everyone can do flooring. Or at least that's something that can be taught fast. 

 

Also sponsoring people means covering all their visa expanses, lawyer work, etc. Also brining their families.

When I went on the PERM site there are tons of applications for labor jobs (ie farm workers) that do not require a bachelor’s degree.

Yes, there are temporary workers. But floor installation is not like farming, that is needed for just a few months of harvest.

I am fully aware that Americans (or any other nationality) CAN perform the labor.  As I specified above, we are having a very difficult time finding Americans who want to perform the work, can provide their own transportation, and can pass a drug test.

 

We have electronically started the first step of the process.  Perhaps I am asking on the wrong forum, but I'm asking about the difficultly of the process.

Have you tried posting the job with a higher salary and reaching out to trade schools and local employment/career centers?  The visa process might be lenghty, so just thinking of other ideas to recruit some employees sooner.

Have you listed your jobs with the state agency?  Local vo-tech school?

 

Have you considered training  people who otherwise have difficulty finding work - the disabled, convicted felons, ...

 

Are you making unreasonable criteria for the positions?

 

Are you paying a fair wage?  You may expect people to work cheap rather than for what the skill level requires.

 

Does your husband's employer know that he is running a side business - likely taking time from his main job?

Sounds like questions that should be asked of your company's immigration attorney, since they will likely be doing most of the process.

Thanks anyway, folks.  Very unhelpful and not answering the question I asked.

 

Felons are not welcome in our business.  We spend significant time in people's homes and have a reputation to uphold.  Employees must pass a background check and drug test.  

 

The wage is the fair wage for this position based on our market.  

 

The criteria is show up and work hard.  We offer to train.  Is that too unreasonable for you?

 

Yes, his employer knows he runs a business.  Yes, he has done jobs for people within his company.  No, it does not take away 60 seconds from his job.

 

What the hell?  Righteous much?

This is a do-it-yourself site.  This is a small business.  WHY is everyone here so damn confrontational?  OMG, this site was so much more helpful when I was working on the adjustment of status.

True (well kinda...VJ itself is not a DIY site but a community), but this is a process that is normally handled by an immigration attorney...family-based immigration is very different than employment-based immigration.

I don't know of any trade schools in my area, but I'll try to look some up.  We do have a community college that offers some trade courses, so I will see what I can find out from there.  Good idea.

EB3 is the immigrant visa category, the fact that you are asking here is slightly worrying, something best discussed with the Company Immigration Lawyer .

 

As an aside you would still have the same issue, nothing to stop you going through a long and not cheap process, they come, they work, they get a better offer elsewhere and move on.

 

My guess is that the Drugs test is killing you, I obtained a side job which required one, soon as I saw that I knew the job was mine.
