Hey guys,

 

I am a K-1 visa holder applying for AOS, and my USC husband is my only sponsor of Form I-864. I am trying to figure out how to answer Part 6 / Item 24, which asks about the sponsor’s total income for the last 3 years (2017/2016/2015).

 

In 2015 & 2106, my husband and his ex-wife filed taxes jointly. So for those 2 years, should we still take the income reported on line 22 of his Form 1040/1040A as the total income here? If so, should we also attach his 2015 & 2016 IRS tax transcripts to prove he always made enough money to sponsor me? Or since only the evidence of the most recent year (2017) is required, we better not bother submitting 2015’s & 2016’s?

 

PS. My husband’s previous marriage ended in 2017, so he filed tax as single that year.

 

Appreciate if anyone can help!

You need to provide the most recent years transcript only .. 2017.... but you will answer the questions regarding the income for the past 3 years 

Current year estimated income must meet the 125% level... previous years income is not necessarily a problem even if it has been less than 125%

But my question is: since my husband and his ex-wife filed taxes jointly in 2015 & 2016, what total income I should put for these 2 years respectively? Solely my husband’s income? or their joint income, which is line 22 of form 1040 tax return?
