My fiancee first visited me from this past May to June. We submitted our application for the petition for alien fiance about 2 weeks ago. My fiancee plans to come to visit me in again September and stay for about 3 months until December. Would staying that long that soon after the first visit and during the k1 process be okay? Thank you.

If permitted entry and issued an I-94 for that duration, then sure.

Expect increased scrutiny of immigrant intent with a USC fiance and pending petition but visiting is absolutely permitted. The more face time together, the better.

Agree, visiting was never a problem. My fiance has an ESTA which permitted him to very easily cross the border without scrutiny. We did 6 trips back and forth each. He was just always was asked when he will be returning. I'm not sure if the time frame will just enter into more questions, which I can see being a possibility, but as long as your fiance can prove their intent to return back to their country there shouldn't be an issue.

It doesn't matter how long your fiancee will stay with you. The requirement is at least you met once and have photos to prove it,

My then fiance (now husband) came to visit me in New Jersey on February 4, 2018, with a return flight of April 7, 2018.  When he arrived at the airport, the CBP officer was very nasty and told him, 'he couldn't just come here for however long he wanted to come."  He accused him of coming here to work and asked him what he would be doing during the day while I worked.  He finally said that he could easily put him on a plane back to Spain and to never try that again.  I will tag @Brittani cause something similar happened to her fiance.  Just be prepared for a lot of questioning.

My fiance comes down here from Canada every few weeks for a long weekend.

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....
