Hi,

I am planning to file I130 and I485 concurrent filing for my parents as they are currently in the US. However, I have a couple of questions.

1) Is I864 (Affidavit of support) needed?

2) If my parents do not have a birth certificate would their passport be sufficient?

3)If they do not have a marriage certificate, is there a format letter that can be used and get it notarized to show that they are married? Or can I file it separately so that I don't have to show the proof that they are married?

 

Any help is greatly appreciated.

  1. Yes. One for each parent. If they are not of working age, expect to require showing evidence that their healthcare expenses will be appropriately covered (i.e. via insurance).
  2. No.
  3. They will need a marriage certificate (or similar acceptable document...https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country.html)

Thank you! If they do not have a birth certificate, is there an affidavit that can be used.

 

Can anyone provide a sample affidavit for the birth certificate as well as a marriage certificate?
