Biometrics are done during the AOS process is mandatory in order to receive your green card and the EAD/AP combo card. You have to be fingerprinted again in order to have a background check done and your photo taken. Keep in mind that the K1 process is separate from the AOS process and therefore the requirements are different.

 

Even when it's time to apply to remove conditions, you have to do the biometrics part again. So your case will be rejected and sent back to you due to filing an incorrect fee. They won't cashed your check so you don't lose your money. Just resubmit with the correct filing fee amount once you receive it back.

The K1 expires on 9/16. What happens if we don't get it back in time to re-file? Would that mean she has over stayed if we do not refile before the 16th?

She will be fine as of now she's met the 90 day requirement. The K1 was voided after she went through POE. Her I-94 is what she is using as her status. As long as you re-file as soon as they send it back you have nothing to worry about.

What about these new rules going into affect on 9/11/18? Any thoughts?

 

Were both just so upset. My work was slammed while we were trying to get the packet together to send and for whatever reason we both ignored the fact that everyone was saying $1225 ugh! Just want this done!

The new rules have nothing to do with your situation. You filed your paperwork with the incorrect fee amount which happens more than you know. They will just mail your entire packet back to you along with your payment. All you have to do is write out another check for the correct amount which is $1225 and resubmit. It's not considered a denial because they haven't even scanned in your paperwork for it to be put in the queue for review.

 

Mistakes happen so it's understandable that you might have overlooked this. The best part about it is that they don't cash the check so you don't lose any money.

Call USCIS on Monday, tell them about your error and ask if you can do this second option: cancel the first check you sent, print out the whole package again and send it to them. This way they will receive the correct app before the I-94 expires, and you won't have to worry about how long it takes to get the first incorrect package back.

He said the K1 expires not the I-94. But either don't really matter at this point. Customer service isn't gonna be able to assist over the phone. He will have to wait until they send the package back. They're not going to cash the check because the amount is incorrect so they will return the entire packet along with the check.

 

At most, his wife will be fine should you receive it after her I-94 expires. She would be considered out of status until they accept the petition but it would only be a few days of which can be explained if ever questioned.

You are correct, I just provided a second option. I know it's costly, but in my case it took them 3 weeks to cash in the check. I was 4 days before my I-94 expired, so I called them to ask them about it. The tier 1 officer offered to connect me with a tier 2 and I got my receipt numbers. In the end it's their choice if they want to try to resend it now or wait for the first app to come back.

hi guys finaly got my package back today and the rejection notice said the application was filled on an outdated version of the form. honestly so honestly i dont know which date are they considering the date on top of the form or the date down the form i haven't check the date that's down there even. anyway i got my entire packet back.

what should i do now use another form for the I-485 and send the same package back to them or use another form for EAD AND A?

Go to USCIS website and check the bottom date on all forms. If it's different from what you already filled out, then you have to use the latest form for EAD/AP from USCIS. I would do that either way, just because you have to date the forms when you sign them.

thx you. i was checking that when you send the reply. all the forms are still the same and only the AOS I 485 AOS DIFFERENT. so i guess i should print the new one.

what would you suggest to me for this?

except the aos that i need a new form for, should i send everything else back as the staples it ? because every document have a printing at the bottom, a line a kind of signature or should i reconstitute evrything meaning each form with it supportive dicument?

I would just print out only the new forms for EAD/AP and fill them out and date them.  As for the supporting documents I would send the same as before (just double check everything). Also remember to change the date on your cover letter. And pretty much that's it. The reasoning behind my advice is that by having a more recent date of the signature, it shows that the information provided in that form is the most recent one. But that's how I see things.

You're welcome. I guess for me it's easier because I filled out my forms on my pc, so I just have to change the date and reprint them. If you have to rewrite everything then you might make another mistake. Honestly, I get it. 

If the date on the EAD/AP is not that far ago, then just send those with their corresponding supporting documents.
