RFIE i485 SENT AFTER WAITING 7 MONTHS

Timeline

Hi I'm a US citizen born and raised. My wife and i have been married 3 years. We moved to US last year after she got into a university here. We applied for AOS I485, I130, I765, I131, i693 etc after first semester. 

We sent documents in January 2018 and now August 1st received a txt saying a RFIE was sent out August 1st. We have had no other updates since the biometrics appointment but now this... 

Our package was huge with a tonne of evidence and the medical and joint sponsor forms ( as I havent filed taxes in the US because we lived in th UK where I am also citizen. ) We have been together for nearly 10 years and proof in pictures etc and other evidence.

So we are really worried what this RFIE could be about and or what problems we could encounter given we submitted everything and more then what we had to...with help from a immigration lawyer.

Service center is MSC and local office Charleston S.C 

Any info or experiences you could share would be so greatly appreciated!

It's all speculation on what it could be until you get the notice. Common causes are:

  • Missing I-864 documentation, or being insufficient in meeting the requirements
  • Incorrect or missing Marriage Certificate (MC)
  • Incorrect or missing Birth Certificate (BC)

#1 above sounds most likely...what did you send for your I-864? Did you include the letter stating that you were not required to file taxes? Note that USCs are taxed on worldwide income...so if you worked overseas, you probably had to file taxes. if so, that needs to be resolved first.

Did you include a signed letter stating that you were not required to file US taxes because you had no income for 2015-2017?

Edit: September 2017? That would mean you had to file 2017 taxes at least.

It's difficult to second guess what the RFIE could be for and it might be something trivial. I received one asking for proof of birth, even though I had sent a copy of my birth certificate. I didn't have anything else to submit, so I submitted my actual birth certificate (instead of a copy) in response to the RFIE and it was accepted.  At my AOS interview, I asked why I'd received an RFIE, as I could see the document I had originally submitted in my file on the desk in front of me. He said he had no idea as it all looked fine to him, but for some reason whoever received my case didn't like it, most probably as they weren't used to seeing a birth certificate from the UK.

Thank you for y'alls responses, I only started working in March this year, and moved here September last year sorry fir the confusion. I however did write a letter of explantation as to taxes...

Don't worry about the RFIE. USCIS sometimes overlooks the package and asks for things you've already submitted.

 

It could literally be anything:

 

I130A

Birth Certificate

Marriage Certificate

Medical exam results (which doesn't need to be submitted till interview, and the RFIE will be seen as just a courtesy reminder)

I864 

 

It could also be questioning whey your wife comes in via an non-immigrant visa (F1).

But anyway it's good to receive updates from USCIS than having nothing.
