Ead expedite... do I need to take the job?

I have a company with a job offer willing to expedite my EAD. However, I dont want to actually work there because my current TN job makes a little more money.

 

Is this a plausible idea? Take the offer, then say no after EAD is expedited? (Yes I know itll look really bad to the company) but I really need the EAD/AP

TN to GC: AOS through marriage

 

Paperwork received: 4/9/18

Biometrics complete: 5/7/18

Ready to be scheduled for interview: 7/16/18

EAD/AP Approved: 9/4/2018

EAD/AP Card Received: 9/10/2018

Interview Notice: ???????????

aside from being  a REALLY shitty thing to do, and possible fraud of some variety, its possible the company expedites your EAD, that you are obligated to work for them until your get your greencard 

 

really not sure, but it seems it would quasi fall under work permit visas where its the company 'keeping' you here. 

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

Without knowing the circumstances I don't know if it would work or not to get the EAD sooner, but it's not cool at all. You're causing that company to use their time and resources to help you out, only to stiff them afterword. Sorry to put it so bluntly, but if I was that employer I'd be fuming.

He/she would be adjusting status from another type of visa - like H1B that allowed them to live/work in the US.

Well, it could count as fraud since you're not planning on taking the job and expediting EAD to do so. Also, just because they approve EAD doesn't mean they will expedite AP. Outside of ruining your name with the company, you can ruin your name in the local area and one day, those recruiters will move companies. From a business perspective, it's an awful decision. From an immigration one, it's fraud.

Is getting an early EAD worth getting in trouble with fraud from USCIS and potentially losing your immigration benefits overall?

Translation: Can I use this dumb company's offer of a job to hoodwink USCIS that I will lose the offer, have them expedite my EAD, and then have a wry, cynical laugh as I pocket my EAD and send a one-liner to the company telling them I rescind my acceptance of the job?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks,  I didnt think about it that way. Definitely not going down that route.

Why can't you just have your current employer put something in writing? Let them write a letter saying that they want to keep you and that you will need your EAD to be able to keep working for them. Then you can request an expedite under the "financial loss" category, because you would lose your job if you will not receive your EAD. To me, this seems to be the easier and more honest thing to do.
