Divorce before ROC?

So my husband and I are not on good terms and I’m really looking to get divorced somewhere along the line if things don’t get better . I will be applying for the removal of conditions in January and want to know how a divorce would affect my residency?

You can file for removal of conditions with a divorce waiver; it's easier if you have the final divorce decree and can send everything right away - otherwise you might have to deal with a RFE. It will complicate things (but still be possible) if you get divorced whilst in the middle of a joint-filed RoC application.

 

Your residency won't be affected until a decision is made on your RoC. Make sure you have a lot of evidence to prove a bonafide marriage and you shouldn't have any issues with your application.
