I am very new to this site. 

My sister-in-law from the Philippines on a J-1 visa, got married to a Filipino man who is on his 10 year green card.  The sister-in-law J-1 visa runs out by the end of September.  The marriage was [performed by a US judge in Washing, DC.  

Can some of you members, please help me help them on what she must do to stay here??  She is running out of time!!!

The only way she could remain in the US is if she maintained legal status until her priority date became current.......2 years from filing...

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It means to be have LEGAL presence inside the US via an unexpired visa or to be within the authorized stay period given upon entry to the US.

Hello po unfortunately your SIL married a man that is not a US Citizen but a green card holder. So that means that they need to file the paperwork na and wait 2 years before she can come back on that visa. Once her J1 visa is over with she has to go home, she can not adjust status in the USA because her asawa is not so citizen.

She cannot stay in the US as mentioned before as her husband is a LPR, and not a US citizen.  She must go back home first before the J-1 is expired.

As her husband is a green card holder and not a US citizen, she cannot adjust status. That means that she can only stay for as long as her current visa is valid (September). That is what @missileman is saying. Unless she gets another visa on her own, she can't stay and has to return home and wait the process there. As others have mentioned, the wait time for the spouse of a LPR is 2 years. After two years her spousal visa will be approved and she can return to the US.

06/27/2017: NOA1 (technically a RFE as we were missing beneficiary ID)

07/06/2017: NOA2

07/12/2017: Case assigned by Juarez embassy

07/17/2017: Packet 3 received

08/15/2017: Interview/Approval!

08/22/2017: Visa received via DHL

09/03/2017: POE

09/16/2017: Permanent Resident Card received

 

Total days from NOA1 to approval: 49
