Extension letter with criminal record PLEASE HELP

Hello everybody I have posted my story here before and there was people who helped me and there was some who judged me ( I know I did a mistake and I don’t need anybody to judge me about it it’s not gonna happen again and that’s it ).

 I got arrested for shoplifting 79$ items and in the court my attorney was able to reduce the charge to petty disorderly conduct without probation or any jail time I just paid fine of 400$.

I filed for I-751 and I want to travel with my extension letter in a month, I know that so many people do that but I am worried about my record. Can I go out of US and come back without being denied entry with my extension letter and the final disposition of the court that says shoplifting reduced to petty disorderly person offense?

That is for the CBP officer to decide, no one here will be able to give you the right answer. 

Your charges should have nothing to do with you been able to travel in and out of the country as long as your have legal residence status.

Technically immigration can stop you at anytime for any reason. The likelihood that they reject you for this is minuscule. You should be fine and free to travel. If asked, just answer any questions 100% honestly and never, ever do anything like that again. It's not worth compromising your immigration status and ability to naturalize.

Hey Hlima hi, 

 

I had the same issue with you before, ' travelling with the extension letter' while your I-751 is still on the process, however I didn't have any legal offense/misconduct or any of that sort (shoplifting or petty legal offense). 

With my case though, I filed my I-751 on January 2012, got my extension letter maybe around March or April 2012, travel back to my home country around September 2012 and came back to the US on January 2013 with no problem at all. I didn't get my 10-yr GC until February 2013. 

 

***What I can recommend you doing is >>> To make an appointment and visit your local USCIS office and have your passport stamped with ' temporary I-551 evidencing permanent residency for one year'<<<.  You cna also talk to the officers there about your case if that will give you peace of mind. Overall, with that letter you should be fine.

@Jo Së I know that it’s up to the immigration officer i am just asking here to see maybe there is somebody with same charges was able to travel without any problem.

Note that you might also be inadmissible to some countries - Canada is known to be quite strict (and shares databases with the US).

You should be ok with the extension letter.  I only say "should" because there's never any guarantee of entry unless you are a USC.

I was always nervous traveling as I have CIMTs on my record so I understand your worry. 

Just answer all questions honestly.

What was a plea deal? Obtain a court certified final disposition, take that to immigration lawyer to see how your plea guilty/no contest or any other affect your immigration status.
