Hi all,

Is there any way that family or a few family members can immigrate together at the same time?

Explanation:

My mother has a child under 21 years old, can they immigrate together?

I think yes,

My father have been petition by his brother(1984), and now it is current.My mother and my younger siblings(Minor) will be joining him as accompanying.

They are now working there papers.My Uncle who is the petitioner already signed the Choice of Agent form and mailed it back to National Visa Center,.

My Uncle is now waiting for the packet to arrive,he will signed the affidavit of support for my family.

Thank you so much for answering my Q.

Let me tell more the situation:

I was submitted form I-130 for my mother already (and in that form I list my brother name) and I thought that my brother will be coming with her, until I hit the point to submitting the affidavit of support form (instructions from NVC), NVC explained that I should petition for all family members form I-130, which is processing dates are different for parent and brother. It means parent will be approved in 1 year, but for brother it will be around 5 years, I become worry that my brother will be left alone in the Ukraine.

Is your uncle petitioned form I-130 right?

5 Years, I think you looked at the wrong category.

If you want them to move together then you would need to time the submission of the applications so that they all became due at about the same time.

NVC Received :

Received DS-3032 / I-864 Bill : 2006-11-15

Pay I-864 Bill 2006-11-20

Receive I-864 Package : 2006-12-08

Return Completed DS-3032 : 2006-12-14

Receive IV Bill : 2006-12-19

Pay IV Bill : 2006-12-22

Recv'd DS230 packet from NVC : 2007-01-16

Recv'd another letter from NVC that they need additional req'ment and which is DS230 : 2006-01-16 (what?!!!! i just recv'd DS230)

Send DS230 to NVC - 2007-01-25

NVC rec'd thru USPS tracking - 2007-01-29

NVC confimed they recv DS230 (2007-01-30) and I-864 (reviewed and ok'd) - need to wait for 2-4 weeks for case completion.

Rec'd RFE from NVC (need certified copy of Birtch Cert. and Marriage Cert.) - 2007-02-13

Sent Mail Cert Copy of BC & MC thru fedex overnight to NVC - 2007-02-13

NVC rec'd Fedex Mail. 2007-02-14

He is petitioning his Mother and Brother

Your father petitioned wife and child.

I found the right answer today from JFC, so I would like to share it:

Parent visa is only for parent and if you want two parents to come you should do separate visa petition for you mother and for your father; other family members can’t join. Even if your mother have a child 1 year old he/she can’t join her; in these case you need to petition for brother/sister first and wait until USCIS will approve petition than you need to file for mother at that time that they will come together.

If you petition for brother or sister and if some of them married their family will join them. Example: Sister has husband and child so husband and child will come with her.
