I  have filed a N-400 for us citizenship Thur the veterans processing center in  Missouri on 06/27/2018. I was wondering if I would be denied citizenship due to a false accusations. I was falsely accused of sexual battery on a minor under the age of 12. The charges Were dropped and the arrest records read nolo prosecution. I have already done the biometric with fingerprints and photo on 07/18/2018 and waiting for the interview.  Do I need to get a immigration lawyer to help me out with the rest of the process?

Nolle pros means not prosecuted. Your case was dismissed or at least the charge that was nolle prossed. If you never went to trial, never pled guilty and never were sentenced, you were not convicted...lawyer isn't a must, and you've already filed the N400, unless you want peace of mind.  Understand, though, that even if a lawyer accompanies  you to the interview----they cannot speak or answer any questions on your behalf unless directly asked by the IO.

 

I'm assuming you properly disclosed the charge on the N400 application and submitted documentation.

I have disclosed everything on my n-400 application and included certified state criminal background ground check that shows nollo prosecution. I figured that sense president Donald Trump has a zero tolerance on any violations, that I might have something to worry about. Thank you for your advice

If you'd been convicted of the offense, then I'd say you had something to worry about immigration-wise (and Donald Trump being president would have no bearing on that...you would have had immigration issues under Obama too, given the charge of sexual battery upon a minor under 12).

 

You were never convicted, you never entered any sort of plea or plea bargain, you were never sentenced, you were never even prosecuted for the offense.  

 

(I am assuming you never even ended up going to trial at all, I am assuming this charge occurred before your ROC, and I am assuming that you had no part in swaying the other party in dropping the charges, as limited info by you has been given.)

No, you do not need a lawyer. As long as you are innocent - you are good to go.

12/11/2018 - I-751 mailed (requested a fee waiver) to Lewisville, TX via FedEx

12/13/2018 - package delivered 

01/02/2019 - received text message from USCIS with case number starting with EAC

01/12/2019 - submitted online e-Request for non-delivery of NOA (the extension letter)

01/24/2019 - received the response to e-Request via e-mail, which says: "Please allow 30 days from the date of this correspondence for the notice to be sent".

01/28/2019 - received NOA (the extension letter), which extends GC for 18 months

01/29/2019 - received biometrics appointment letter

02/08/2019 - biometrics completed

I was living with a woman for about 3 years and things were not working out with her. I meet a different lady and I left the woman I was with.  So in return she made some false accusations against me.  Saying that I had sexual molested her daughter. I was on a trip with the new lady that I had meet.  I was arrested while on my trip. I had no idea about the accusation. I spent 30 days in jail while they investigated the accusation. While they investigated the daughter confessed that nothing ever happened, and that her mom had made up the story so that I could never be able to become a us citizen. So they dropped the charges and police records shows nolo prosecution

You shouldn't have any issues and it should be on record why the charges were dropped. The jail time was most likely because they believed you were a flight risk at the time.  Hopefully the mother faced some sort of consequence for filing false charges.

 

Make sure to bring the original court-certified documents to present to the IO.
