My wife starting a new job

hey guys so just wanted some help my wife who is gonna apply for a CR1 visa in 4 months time just lost her job after 9 years she is looking for a job just wanted to know will this play an effect for the stable earnings for income requirements to bring me to the USA to live with her

Well yes. If she doesn’t have a job she can’t financially sponsor you. She’ll either have to find a new job fast that fits the income requirements or she’ll have to use a co-sponsor. That’s the only way.

She will need a joint sponsor or have someone else sponsor you.

It will if she is planning on sponsoring you.  I don't know her financial situation but I would think her plan is to get another job soon if you aren't her to support her.

She needs to prove that she will be able to support you upon arriving the country, tax returns only show what she previously made.

The I-864 won't be needed until after the I-130 is approved. Unless you are doing DCF, this is ~6-10 months from filing, which should be plenty of time to establish stable income that the CO will consider. Nobody can know what they will decide...they make a decision based on the totality of the circumstances.

If you are doing DCF, only a month or so may be too short to show stable income. Again, no way to know beforehand.

so will she need to be in her new job for 3 years before filing the cr1 or is it just to show proof of of 3 years of tax filed whatever the job new or old?

3 years of tax filings. USCs are taxed on worldwide income so she should have been filing them while working abroad. If not, that needs to be rectified first.

oh okay so shes living in the states we just got married ive come back to london she is gonna lose her job soon but is looking for a job when she finds a job we are gonna file the CR1. After the  I-130 is approved which should take 9 months or 10 and she is still in her new job then what would she need to show the 3 years of tax filings and would se need to show anything from her new job?

She would need to provide:

I-864

Pay stub(s) (I provided 6 months of them, but that was probably overkill)

Employment letter, if possible

At least the most recent year's tax return. The other 2 years are optional as noted above.

 

Evidence of any assets being used, if any. If no assets are being used (they are optional), then no documentation of them is needed.
