I-130 filing

Can anyone please help me concerning what to include when filing the I-130? Do you include wedding pictures, emails, chats, ect. showing how and when your relationship started or do you only include these items for the interview? The only thing I can find is that you need to show intermingling of finances, a lease with both your names on it, etc. I will be filing on Monday so really need to know how others put it together who have already filed.

I would really appreciate everyone's help.

Thanks,

Deb

Hi:

I would save emails, chats and finance information for the interview. I included wedding pictures, wedding invitation, marriage certificate and an affidavit form the priest who performed the wedding ceremony along with the actual application, passport photos, check and citizenship certificate.

Good luck!!

The required supporting documentation is pretty clearly spelled out in the I-130 instructions. There is also a list of "should include 1 or more of..." in those instructions. Many of the optional or "should include" items are not going to be avialable to newlyweds who haven't lived together in the same country yet. The last of the items on that list refers to anything else you think might help establish the bona fides of the relationship. Your official marriage certificate establishes the bona fides of the "marriage act" but not of the "relationship". If you had a big wedding with invitations and such, that would be unusual in a sham marriage, so including some evidence you did more than go to the government office and do the paperwork can't hurt. If you've had time to add your spouse to your phone or other utility bill, that would be good too.

Nobody is going to give a lot of credence to affidavits from people who don't know anything more about your "relationship" than to have attended a party in your honor and observed you seemed affectionate and ready for a honeymoon etc. I think its a waist of time unless people have actually observed your relationship over time.

Since my husband and I got married this past January and live in different countries, the only evidence that we could send in from the list on the I-130 instructions were affidavits from my mother and sister. We don't have joint bank accounts or lease/morgage agreements in both our names, so all we could send in were the affidavits. My mom was at the wedding with us so she wrote a small paragraph about it and my sister also said that our marriage was bona fide. I sent that in with the I-130 and 88 days later we were approved with no problems at all.

Deb, don't worry about sending in pictures, e-mails and all that other stuff. Affidavits will be fine and if you have any other document such as bank statemets or lease agreements that would be better, if not, don't worry about it.

I don't see haw affidavits can hurt anything but remember it is bona fides of the relationship, not the act of legal marriage they are evaluating. The marriage certificate says you got married. Fraud marriages have those too.

I know, I'm beating my head against the wall and nobody comprehends the difference. So be it. :)
