thank for replying fast she makes 3K a month and she didnt aork two months because of summer holiday you know

So 36,000 a year. I believe that is above poverty guidelines.

 

Before you guys file, have you met in the last two years? Are you both ready to invest thousands of dollars into this? Do YOU have any savings that you'll bring to the US?

 

I know they are uncomfortable questions, but this is more than just a yearly salary. :)

yes we've met ;why thousands of dollars ? im asking is it enough or i need a co-sponsor .?

I do not think she will need a co-sponsor.

 

You're going to need money to 

1. Move to America, including plane tickets

2. Survive when you get to America

3. Plan a wedding

4. Have money saved because you won't be able to work until you get your green card or right to work

5. You'll have to file and adjustment of status, advanced parole and employment authorization (which is over $1,000.00)

6. Go out and have dinner, have date nights

7. Various expenses

 

So that's why I asked.

So that's why I asked.

i have some savings and im going to take care of that but im worried from a paper work and regulations perspective and tax return also ?because she doesn't have that

The I-134 isn't needed until the interview. Unless you already filed a while back, you have ~8-12 months of working to establish stable income. I doubt it will be a problem.

The CO makes a judgement call on the public charge concern based on the totality of the circumstances.

 

And yes, the K-1 -> green card process is expensive:

I-129F: $535

MRV (K-1 visa application) fee: $265

Medical exam: ~$200-$400 depending on country, with potentially more for necessary vaccinations

Ticket(s) to US: $x

Wedding, certified copies of marriage license, etc.: $x

I-485 (AOS) + I-131 (AP) + I-765 (EAD😞 $1225 (only the I-485 has a fee for this circumstance)

They will need a signed statement that they did not earn any income and therefore were not required to file taxes.

Read the post after mine.

 

You should fill out a timeline, Adam. Also, if your girlfriend is the USC, it might be better to have her come ask questions as she's more familiar with things like taxes and the like.

I-129F is for a fiance/fiancee. I-129 is a petition for an alien worker. :P

Yes, the I-129F is the first step. The guide linked above has what is needed through the K-1 process, except embassy-specific documents, which will be provided either via email or snail mail once the petition is at the embassy/consulate.

 

There is also a guide for AOS from a K-1, which will be needed after arrival and marriage in the US.

Also, it is taking anywhere between 6-10 months (a very wide range of time, some people get lucky) to even get approved for the I-129F. After that, you have to file the AOS
