DCF in London after K1 earlier? (split and merge)

My husband and I currently are residing in the UK. 

 

In April 2015, my husband (then fiancé) came to the states from the uk on a K1 fiance visa. We were married in June 2015. He then received his green card and right to work shortly after that.

 

To to make a very long story short....He’s a music teacher, and we had some issues transferring all of his teaching credentials over. The dept of education wanted him to go back to college for a specific teaching music degree, even though he has his teaching qualifications as a general teacher in the uk and had been teaching music for 7 years prior. Anyhow...we decided to move back to the Uk together, as my special needs teaching qualifications from the US were accepted straight away. 

 

So in late 2016, we started my visa process to come to the UK. I’m here now....I arrived in April 2017 and everything has been fine. We’ve just been kicking around the possibility of moving back to the states to be closer to my family....as I’m not sure I love it here. But after residing here in the UK, my husband had to forfeit his green card. 

 

My point...if we want to return to the states to live....do we have to basically start the whole process over again, but with a K3 this time?.  Or, is there a different, faster route we can take since we’ve already been through it once before?

DCF would be quickest option. Otherwise could do CR-1; but DCF again is a lot faster.

08/15/2014 : Met Online

06/30/2016 : I-129F Packet Sent

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Nope. K3 doesn’t exist anymore. You start all over but with an IR1 with a much longer wait. 12-16 months.

Yeah DCF is also an option. Much faster.

It may be somewhere in the forum, but I feel like I remember a few of you helping out the last time I was doing my husband’s K1 visa in 2014/2015 so hopefully, someone will still reply to this thread as it’s from a long time ago.

My point...if we want to return to the states to live....I understand that a DCF would be the quickest way for us to do so. So I’ve been looking over the process this morning and I just need to clarify two things.... Can I do a DCF through London? 

 

And my second question is about the affidavit of support. How does that work as I’m obviously not working there at the moment.  Ideally I’d want to moved with a teaching job secured before I get there...but I can’t find any info on how much I have to be making, etc. and if I’m not currently working in the states, how does one prove support?  I think that’s one of the only things I’m struggling with as I begin to look into everything.

You can have a joint sponsor who lives in the US OR you can return early and start a job. The promise of a job won't work for this.

What Wuozopo said. You can have a joint sponsor who lives in the US. Or you can move back to the US before your husband and start a job. You will have to be living in the UK to file the I-130 via DCF but you can leave pretty much any time after that. Or you can use assets if you happen to have $60,000 worth of assets lying around somewhere. (Assuming a household of two.) (Also, remember to file your US taxes every year!)
