I made a major mistake - please friends guide me

Disaster strikes!!!

First, When filling out our petition I said that my fiancé has never applied for a U.S. visa.

Well, we were going over some paperwork together and we came across some sample questions for interview time. Reading them together, one was "has the beneficiary ever applied for a U.S. visa.?" Apparently About 8 or 9 years ago some friends and him applied for the lottery or workers "green card" - whatever it was - while they were in some cyber cafe.  He paid money. He never knew the outcome and thinks it was fake but there is no way we want to take that chance with our government. I don't want them to think I am in the dark about this or that we are trying to lie.

I took responsibility for pretty much the ENTIRE petition and I NEVER even asked him that question. I just assumed it was a no so I marked no!

I feel like such a dumb@$$$ 😣

Please, I don't know what to do. We in no way want to lie.

How bad is this?!

My fiancé also put his name down for the visa lottery but never heard anything more from it. He also paid a little money to the person to put his name down. We are applying for the k1 visa and we just was accepted And received our noa2 July 11. We are now waiting to schedule the medical and the interview. I think putting your name down for a visa lottery is different then actually applying for a visa. If his name was drawn and he actually applied, then that would be a different story.

The question is "did you ever apply for a visa". The answer is NO. Even if this whole lottery thing was legit, which I doubt, he did not apply for a visa. The answer is still NO.

Just to reassure....

The www.Travel.State.Gov site says (under the Diversity Visa Lottery section in the “if you are selected” FAQS #27)

”Being randomly chosen as a selectee does not guarantee you will receive a visa. Selection merely means that you are eligible to apply for a diversity visa”

My fiance entered his information into the lottery in 2016. He did not win the lottery. He did not declare it on the DS 160 (because he never applied for a visa to the US). I explained to him that questions maybe asked at the interview regarding the lottery and he was prepared for those questions (none were asked).

As the other posters have said....the answer is “no” if it was just a DV entry

First of all, I feel if your fiance never received an official acknowledgment from government for the visa that he applied years back then you should consider that he never applied.

 

Secondly, you should consider of getting in touch with either writing an email the beneficiary's US embassy/consulate or call on USCIS customer care (1-800-375-5283) to share your concern and ask them for a resolution. You may also inquire about the visa application to check if it was ever filed with them.

 

The USCIS customer care is very helpful and the right people to address your concerns.

USCIS T1/T2 representatives cannot answer a question about an individual's past visa application (or lack thereof). Visas are handled by DOS.

Entering the DV lottery is not an application for a visa. That only happens if you are selected and choose to apply for the visa.

Generally one would be aware if they applied for a US visa or not...it's not something one does on a regular basis and it is a decently lengthy form requiring a bunch of details.

Thank you guys.

Let me first say that the question "Have you ever been denied a U.S. Visa" is NOT - I repeat is NOT asked on the I-129F like I so frantically remember it being. It must be the Mediterranean heat burning holes in my brain! I am sorry for getting my panties in a freakin'TWIST! Thank you all for your answers. The petition only asks if fiance has ever been, or is living in U.S.

 

The question "Has your fiance ever been denied a U.S. Visa" IS - I repeat IS on the DS160. We have not reached that stage yet. So I panicked a bit again and asked you if we would say "no" or "yes" to that. My fiance has a TERRIBLE memory. All he can remember is that 8 years ago, he followed a click bait Facebook page that guaranteed him a U.S. Greencard - blah blah lies I'm sure. He followed the link, paid some money, gave some info and NEVER heard back again.


From what I gather, from all of you, we will still answer "NO" to that question on DS160. That is what we will do. If he is asked about playing the lottery he will absolutely tell them what happened. Hopefully he will not tell them a novel out of fear, lol. That is what we will do.

I honestly think a moderator should lock up this thread to prevent people from coming up with all sorts of wrong suggestions. The right response (which is ‘NO’ on the DS260 form) was already provided in the first two pages of this thread, I don’t get why some with absolutely no understanding of the DV process continue to post all kinds of other irrelevant suggestions. Just saying!

It's on the DS-160.

See page 10: "Have you ever been refused a U.S. visa, or been refused admission to the United States, or withdrawn your application for admission at the port of entry?"

There's also a question if they were ever issued a US visa.

If one applied, they should fall into either one of these 2 categories.
