Hi All!! :)

I called USCIS last week and asked about filing n400 during I-751 process. The lady said I can as long as I’ve lived for 3 years in the US as a permanent resident. Also I can apply for N400 if filed Form I-751 has been in their system for 12 months. I know it’s in their page but the 12mos thing is new to me haha so yeah I thought I’d share! :D:D:D

Cheers!!

That's really interesting - I'm able to apply for citizenship in August, and by then my I-751 will have been in the system for over a year. I'd like to understand if I should file N-400 or wait until I-751 is finished first. I've read conflicting (anecdotal) reports that applying for citizenship pushes you to the back of the I-751 line again, or conversely that filing prompts them to approve your I-751 quicker, or that it makes no difference but when you turn up to the citizenship interview they can turn you away and tell you to come back when your I-751 is approved. Would be great to know if there was any advantage/disadvantage to filing the N-400 or not. But as with most of this process, it's entirely opaque 🙄

Here is my thinking at this point.

CSC is somewhat processing cases quicker than VSC. If a person's case is at CSC and the case has not been moved to another processing center then holding off on applying to N400 makes sense around a 12 month mark for waiting to get the approval of i751. If they sent the case to the local office which would be an indication that they might require an interview to approve i751 then it would be best to file N400 as soon as there is a notification about the i751 case being moved to the local office.

In other case, applying for N400 as soon as the window opens at 12 months waiting period of i751 might delay the approval of i751 by six months or so. It could be irrelevant for some if they are willing to wait out to conclude everything with USCIS once and for all by getting naturalized.

First of all, USCIS hates the predictability, period!!!!!!! (They kinda wanna act like sheriff in Wild West historical era when they are the king in the town with bare minimum civilization code of conducts)

Just because filling N400 forces I 751 to be adjudicated does not guarantee anything. Many factors are involved.

Case 1) If your I 751 is already assigned on reviewing officers in service center (eg: CSC or VSC), then filing N400 does not trigger anything to I 751 since assigned officers will complete the review and make a decision

Case 2) If your I 751 is not yet assigned in service center, then filing N400 will trigger to compile the two applications together and MSC (Or national benefit center) will schedule the interview at your local office. In this case, depending on your local office's workload for N400, you might be lucky enough to have interview and then approved for both I 751 and N400.

In this case 2 scenario, there could be two sub-cases.

Case 2.1) Your local office does do due intelligence on your case, meaning that their office is well-informed that you have pending I 751, they might accomodate your concurrent adjudication for an immigration officer who is authorized and qualified to approve both I 751 and N400. In this case, you will be likely to given a decision of whether or not you pass N400 and I 751.

Case 2.2) Your local office is really busy to catch up the every day life (i.e: daily tasks), and when you arrive for N400 interview, the immigration officer is rockie, who does have a clue of what I 751 is, but has never been trained on the form, or not qualified, then your interview will be likely delayed. Sometimes, the officer is nice enough to bug his/her supervisor or more experienced officer to conduct I 751, but in this case, it is really upto discretion of the officer, meaning that there is no system or manual existing how to proceed, but upto human factor.

USCIS may claim it is run by field manual supported and crafted by INA, but when it comes down to this grey area, it is run by humans, not by rules of laws or any kind of regulations, which is why they hate the predictability

1) No body except USCIS can tell whether your I 751 is assigned on officers or not. So that is completely upto applicants' fortune.

2) Every local USCIS office has slightly different practices depending on the leadership teams and staffing availability as well as many other factors. So some local offices are extremely efficient to take care of concurrent adjudication of N400 and I751 (probably because they have multiple applicants and various experiences), but others not. While this can be understandable, this difference ultimately contribute human performances, not system followed by specific manual and guidelines. Additionally, upper USCIS leadership team (eg: service center and national benefit center) fails to provide clear guidances, so each local office has to figure this out by themselves without their supervisors so that is another huge issues.

Hope this makes sense.

The 12 month requirement makes sense though: you wont apply for I751 until  2 years (-90 days), 12 months on top of that makes it 3
