You are sending your packet out this weekend,  so you are considered as a Sept filer. You would prbly be sending it to Arizona I would say. Whether your case will be delayed or not, no one can say...

 

From one of the uscis agents, she said yes you could do an infopass appt to get a stamp. But what I am afraid is the person at the office may reject you...it really depends I think. i would say yes go get an appt and see what they can do for you, but maybe not make the appt until middle of oct? Give it a little time first.

At my info pass appointment they refused to put a stamp in my passport. My green card expired few days ago. They said that without receipt there is nothing they can do. They are very unhelpful and don't really care.

Really, what do you expect them to do, stamp your passport based on your word?  How can they possibly stamp your passport without a receipt that you filed for I-751?  Yes, it's very disappointing that it's taking so long.  The delays make it even more important to file 90 days before green card expiration.

@Maggiamerica I have been saying this and warning community. USCIS is no longer a customer service oriented based on new memos. I would still ask you not to panic, my green card was expired for 4 weeks before I received my NOA1, the law protects us in a way by saying that we are still residents until immigration court order us deported.

My husband and I just called uscis. The lady that talked to is was actually pretty helpful. During the phone call she retook my husband's info and mine and sent it to the Cali service center to get any updates for us. She have us a confirmation number of her action that She did. And also took down our email and mailing address. She informed is there are delays at the center and that we should give it another week to see of the ppl over there can send us an email or mail to let is know of any updates with his case. If a week goes by and nothing happens, she said to call them again. During then they will have a higher level officer help look into it.

 

She did also mention that ppl wont prbly stamp his passport if we did an info pass appt just because his case is most likely delayed and just as long he gets a receipt then it is better than the stamp. So maybe call them and see if they can do the same thing for you.

The fact that they don't care is why I get anxious and impatient. Already dealt with this once before during the I-130. (The not caring. Changed the papers needed while packet was in transit and blamed me). I get the law protects us in a way, but being a minority I don't trust the law as far as I can throw it. 

 

Plus my wife's work is asking for the NOA

Filing within the 90 days window is good enough, anything earlier the ppl will just reject. Sometimes ppl need time to gather their info.

That sounds promising, please keep us informed. I'm not at the 30 day mark yet, but I have been following everyone else here. Seems like no one, who submitted after August 8th, has heard anything

That's why people need to get prepared prior to the 90 day window.

Yes I will keep everyone updated. I do hope to hear something so I don't have to have my husband call so early in the morning.

@Hccaldwe Welcome to America, my friend! Only in this year alone following has happened that I have witnessed personally as an immigrant. 1. My employer has laid off minority as you mentioned 789 Indians in just 45 days because of changes to H1B visa. 2. The record number of cases are pending in immigration courts even more than during the time of 9/11 when the government first cracked down on legal immigration .3. I have been told by ex legal counsels and this is nothing to afraid anyone on this forum but the 18 months extension is intentional to prolong cases to limit citizenship eventually and restrict immigrants after 1990 who have not applied for citizenship yet to green card only. I am ready for any outcome as efforts are consistently being made to make sure that population is reduced in America by deporting legal immigrants or limiting citizenship as you leave for more than one year you lose green card anyways so it is a well sought out plan. Watch news it is depressing and is pointing in the direction of things to happen. 4. I am posting a link as now even the immigration judge's power to grant our stay has been taken away by DA.

Again, I don't want to be the bearer of all bad news, but I am just trying to inform my friends here that it is what it is. We can't do much, living in this country is by our choice and it is up to the law of the land to grant us that permission. Also, law of the land has changed so drastically in just last 4 months that it has kind of told me where it will end eventually. It is frustrating we pay taxes like a citizen, abide by laws just like a good citizen and some of us like me who have lost all of their inheritance, savings when they moved here to live with their spouses to divorce settlements and end up living in a car but can we do anything? No, because the family courts will treat you as a citizen and not an immigrant. Guess what because they want your dollar and don't care. So, all I can say some of us are still in better positions so just hang in there as it will take some time to know the answer for sure for all of us.

 

Cherish the moments you have right now and keep your hopes high but also keep your eyes open.

When you check your status online at https://my.uscis.gov, you will see this number displayed.

If you call this number you can speak with an agent to inquire about your case.  (As I was wisely advised, keep pressing #2 until you get to speak with an agent -- works every time!). The agent who answers this call is a Tier 1 Officer.  You can ask him/her to be transferred to a Tier 2 Officer if you have a major issue that cannot be resolved at the Tier 1 level.  Some agents will transfer you; some will not, depending on what your issue is; keep trying with different agents if necessary.   (In our case, one of our three applicants received a NOA to redo her biometrics appointment in May of this year; she did this initially in June 2017.  After we didn't hear anything for four months, we called the above number.  The agent placed us on hold for a few minutes to do some research.  He discovered that our case had been mistakenly returned to storage (VSC).  He transferred us to a Tier 2 Officer and we received approval two days later.)

 

A form I-797, NOA = a Notice of Action.  A NOA can convey many different things.  Yes, a NOA can specifically convey a 12 month extension.  It can convey an 18 month extension.  It can convey a biometrics appointment requirement.  And, a NOA will convey that your I-751 Application has been approved.  All depends on the contents of the NOA.  People here refer to the initial 12 month extension NOA as a NOA1 because it is the first one that you will receive.  The NOA1 document is your extension letter.

Thanks for the info. I figured my own questions out after doing some research. 

 

 

But when someone say noa1 to noa2, what does that mean?

 

When you get a biometrics notice is that considered noa2? Like stage 2 of the process?

NOA 1 & 2 are simply shorthand terms used here at VJ.  NOA 1 = the first Notice of Action that you will receive, i.e., that your Conditional Resident Status is extended for 12/18 months.  NOA 2 is most often the second NOA that you will receive which should be your biometrics appointment.
