In summation, it does not lead to a cancellation of visa unless you’re a Trump fear monger. 

 

Why would anybody body want an extension? I extended my tourist visa for a year overseas, I see many reasons why.

Rose colored glasses is one way of looking at it.  If you have the money for i539, go for it. Let us know how it goes.

Extensions (and even long periods of approved stay) can be met with scrutiny, because tourist visas are meant to be used for vacations, not to reside in the US.

Well stated! The post said her visa will be cancelled, which I questioned the validity of.

I was referring to your comment:  "why would anybody want an extension?  I extended my tourist visa overseas for a year."   <-----   This is exactly why CBP puts time limits on length of stay for each entry.....to discourage people from *residing* in the US on a B1/B2.

I did not say that it did.  That was a different poster.  I really have no knowledge of whether it would lead to the visa being altogether cancelled.

As to what I said on page 1 is that it does not lead to a automatic cancellation. But if the extension is not granted then you will have to leave ASAP before you start accruing an overstay.

I just wanted to clarify she was just admitted for 60 days but we would like her to stay for 5 months total. That way we could enjoy Thanksgiving and Christmas before returning together to her home country. There is a bit of a gray area about the extension, I am concerned that if denied her visa might be cancelled. My immigration lawyer said with this administration the extension would be a long shot. My research says typically the extension is applied for folks who have been here for 6 months and would like to extend another six. Our situation as explained above is a tad different. Either way we ll enjoy the time we have together and my family will be visiting in January regardless for get this One Month! Take Care!!

I do not agree with the above statement, I do not think that if an extension is denied that the visa is automatically canceled.

Perhaps this is what they meant....If the visa extension is denied after the original visa has expired, they are immediately out of status. If it is denied before the original visa is expired they must leave before the original visa expiry date. 

 

That seems logical to me based on what I have read.

A denied EOS is not automatically a cause for cancellation of the visa. However, one should not expect to be admitted again anytime soon, even if the embassy decides not to cancel the visa.

 

As Boiler posted, nothing to lose by applying if she doesn't plan to visit again. If she does plan to visit again in the somewhat near future, I would not suggest trying for an EOS and taking the 2 months permitted as-is.

You apparently know everything.  A person can easily be turned around and put on the next plane from where they came if there is suspicion of the person entering the country to work, etc...   A visitor visa, 10 years or not can be cancelled at any time.  Thank you for all your infinite wisdom.  From now on I'll just instant message you because you appear to have all the answers.  🤣
