OK so the DS-260 is for the beneficiary,  you need to put in a contact number for them if you are filing it in on their behalf, just make sure to use the country code.

I understand that

but it wouldn‘t let me put in a country code at the section about the petitioner who is living abroad with me!

You will need to amend it.

FIling tax as single when married can cause a red flag in the eyes of the consular officer.

Thanks Abies!  What do I do now.? they return the amended back to me requesting his SSN which I don’t have...

Hi there and welcome!

I’ve received a case number after 9 weeks.

Some embassies recently changed from mailing processing to electronic processing so best thing to do to be completely sure is to call and ask about your Embassy method on how to submit documents.

I’ve got a Case Completed in 9 business days.

Its been a week i’ve since I received CC and I’m currently waiting for an interview date -i will get one accordingly to available slots from my chosen Embassy. So check with other VJ members how long it’ll take to get one in Haiti

Good luck to you and call to find out :)

Thanks Valentina

If you were considered married during the tax year, you can't file as Single or as Head of Household as both of those filing statuses are for people who were considered unmarried for the tax year. (Source: https://www.irs.gov/newsroom/determining-your-correct-filing-status)

If your spouse doesn't have a SSN/ITIN, then you would select Married Filing Separately as your filing status and you have to paper file your return. This is because electronic filing platforms won't allow you to leave the spouse SSN/ITIN blank, but a paper form will. I don't know if it's strictly necessary, but I also attached an explanatory statement to my return when I filed noting that my husband is not subject to US taxes and doesn't have a SSN or ITIN and the return was accepted with no issue.

Now I’m confused 😐 bit stressed about it as I would need my tax transcript soon to submit to NVC.  One IRS rep told me in order to choose that and to be accepted, I need to first use W7 form to request for ITIN for my spouse in order for him to receive a number and then be included if I want to choose option married filing separately.  Without a number he can’t be added.  They sent the whole amended back to me😔and the rep said the W7 can take up to 7weeks.

I’m going to try to write my spouse name on their missing info request and for his SSN states “ unavailable “ and see what they will say (cause when I called they give me hard time and won’t accept it).  They keep recommending that I choose head of household
