If you are discriminated against and you can prove it, then file a appeal. There is a process for that. The fact is if you can show proof that you qualify for the spouse visa, then your color, age, sexual orientation, religion, etc. can not LEGALLY be used to disqualify you. We have anti discrimination laws in the US. Consular officers are not inmune to following them. If you were discriminated against and you qualify for this visa, then FILE AN APPEAL. Consular officers are people too, and they do make mistakes in judgement. That is why the appeals process exists.

All of the facts in your case (differences in color, ethnicity, sexual orientation, age, educational level, etc) will be scrutinized by the consular officer. If you can prove with facts that you qualify for your visa, then the Consulate must issue it to you in the end. Whether it is issued to you at the time of the interview or afterwards at the end of the appeals process, that is dependent upon the facts you present to support your case and when you present them. Consult an attorney if you are concerned that there may be 'red flags' in your case that may signal the Consular Officer to scrutinize you more closely. A competent immigration lawyer will guide you into overcoming them, and will help you file an appeal if your case comes to that. It really doesn't cost that much, especially when you consider the rest of your life depends on this visa.

YES!!!! If there's one thing I can tell people more than anything is to front load at the USCIS stage!!!! It is organized and gives USCIS a chance to give you any extra pointers they feel is necessary. USCIS helped me so much in my husband's approval. 

 

Congratulations to you both!!! Life is about to change so embrace every minute you have with each other. I remember leaving Accra each trip sobbing my eyes out because my husband couldn't even come in to help me load my luggage at the airport. Now he is here with me in the USA and I will never take it for granted. I'm so happy for the both of you!!!

Correct...They may send it back to USCIS for recommendation to revoke but you can rebut all embassy claims and your case reaffirmed.  Ours was reaffirmed in just two weeks.  You'll find many cases with NOIR's that have very biased claims but are very easy to overcome.  

 

If it is denied by USCIS the discrimination would NEVER be mentioned and you would have to prove that it was a factor.  They would have to deny on other terms.

OMG you so right, front load at USCIS and NVC stage is very important. I was the same way when I was leaving my husband and also when I arrived back. Thanks so much for your advice and well wishes. I can't wait to pick him up at the airport in three weeks, good luck to you both

My PD was Nov 1st.  The NVC rep told me that they schedule the interview by CC date.  I notice that usually it takes about 2 weeks for most Nigirians to get an interview date.  But I’m still hoping this will be the week.
