We've had an approved I-129F for a K1 and two approved I-130s for the CR1.  The I-129F just had a couple of photos and passport stamps, the second I-130 just had a couple of things too (and we were living together), the third I-130 had nothing and that is the one that got us the visa.  🤣

Don't expect the USCIS to magically be able to figure out how to match up an additional package to your current case file (it's not going to happen). That's why it's very important for the OP to remain calm and investigate further. They need to press any tier 2 spoken to, need to get on pressing officials or going to infopass. If a notice was supposedly sent out but still hasn't arrived in 30 days, something sounds a bit odd to me.

Oh dear! My fiance is losing his mind, I literally called him as he was about to hand over the package to the USPS and said "noooooo, call USCIS and speak to Tier 2 again first!!" 😂

 

He hates speaking with them now but I have convinced him to just give it one more shot to clarify where the letter is and where we should be sending evidence to. He will definitely be frustrated by the time he gets off the phone with them. I hope he gets somewhere at least.

We've had an approved I-129F for a K1 and two approved I-130s for the CR1.  The I-129F just had a couple of photos and passport stamps, the second I-130 just had a couple of things too (and we were living together), the third I-130 had nothing and that is the one that got us the visa.  🤣

I have my fiance trying to get an infopass as we  speak but they are all booked up. I think maybe he should just drive over there and try to make an appointment at the actual desk, even if it is to come back the following day. 

 

I know we didn't wait that long compared to some, I just don't get why they suddenly decided to deny it?

 

They definitely didn't send an RFE, the post has been checked every day, religiously.

 

We will definitely be going the congressperson/senator route to try and find out the reasons for this decision.

My fiance got through to a very helpful tier 2 officer who advised that, yes, a NOID would be sent. However, there is the chance for us to fix this if we submit everything as requested. (Thank our lucky stars)

 

Most interestingly a NOID has not yet been printed or sent, so no idea where the other tier 1 and tier 2 got the 7th of July from?!?

 

We will receive this decision officially by Aug 9th (a response to our "out of processing" request) and then we can submit the evidence in accordance with what the NOID states.

 

So all in all, everything is not lost!!! I am so thankful and I am really grateful for all of the help and support that everyone has provided me/us with today.

 

Thanks again! and let's hope we can finally move forward. If this new information turns out to be questionable then who knows but, for now at least, I feel like we are getting somewhere.

There is NO reason NOT to send more info. Even if they don't manage to connect the new info with his file, it won't mess up his case at all. Nothing bad will happen to his case if he tries to send more info, he only has things to win by doing it, nothing to lose. 

 

So yes, my recommendation is Still to send the info either way. NOID or not.

 

If/when he does get the NOID, he just sends another response with the same documents/info. No harm done whatsoever.

I agree, the best evidence of actually being together is photos and then passport stamps,  boarding passes and letter of intent to marry.  There's no way I would think of not sending these things with the petition ........ I would expect a problem, even for a CR1.

I understand the desire to say "you deserve it" but, really, you don't have to.

There certainly are circumstances where you can put a date with a photo. But in general, a photo doesn't show a date unless there is other evidence supporting it (i.e. tickets to an event combined with a photos at the event).

Dates printed on a photo are easily added afterwards, so I wouldn't personally put much faith on that making a difference.

It's about the total package of evidence...no single piece is likely to do it, but several items all pointing at meeting in person is difficult to contest. ;)
